                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to eligibility determination and service delivery of

 1-2     health and human services.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Section 9.12(d), Chapter 655, Acts of the 74th

 1-5     Legislature, Regular Session, 1995, is amended to read as follows:

 1-6           (d)  The [In consultation and coordination with the State

 1-7     Council on Competitive Government, the] commission shall make and

 1-8     implement recommendations on services or functions of the

 1-9     integrated eligibility determination [and service delivery] system

1-10     that could be provided more effectively through the use of

1-11     competitive bidding or by contracting with local governments and

1-12     other appropriate entities.  If the commission determines that

1-13     private contracting may be effective, the commission may automate

1-14     the determination of client eligibility by contracting with a

1-15     private firm to design and develop computer hardware and software

1-16     for and provide technical support related to the integrated

1-17     eligibility determination system [conduct application processing].

1-18           SECTION 2.  The importance of this legislation and the

1-19     crowded condition of the calendars in both houses create an

1-20     emergency and an imperative public necessity that the

1-21     constitutional rule requiring bills to be read on three several

 2-1     days in each house be suspended, and this rule is hereby suspended,

 2-2     and that this Act take effect and be in force from and after its

 2-3     passage, and it is so enacted.
