                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the inclusion by the juvenile justice information

 1-3     system of information on all offenses involving damage to property

 1-4     with graffiti.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 58.104, Family Code, is amended by adding

 1-7     Subsection (g) to read as follows:

 1-8           (g)  Notwithstanding Subsection (a), the juvenile justice

 1-9     information system shall consist of information relating to conduct

1-10     by a juvenile that, if the conduct had been committed by an adult,

1-11     would constitute a criminal offense under Section 28.03(a)(3),

1-12     Penal Code, without regard to whether the offense is punishable by

1-13     fine only.

1-14           SECTION 2.  (a) This Act applies only to the collection of

1-15     information about conduct that occurs on or after the effective

1-16     date of this Act.  Conduct violating the penal law of this state

1-17     occurs on or after the effective date of this Act if any element of

1-18     the violation occurs on or after that date.

1-19           (b)  The collection of information about conduct that occurs

1-20     before the effective date of this Act is governed by the law in

1-21     effect at the time the conduct occurred, and that law is continued

1-22     in effect for that purpose.

1-23           SECTION 3.  The importance of this legislation and the

1-24     crowded condition of the calendars in both houses create an

 2-1     emergency and an imperative public necessity that the

 2-2     constitutional rule requiring bills to be read on three several

 2-3     days in each house be suspended, and this rule is hereby suspended,

 2-4     and that this Act take effect and be in force from and after its

 2-5     passage, and it is so enacted.
