                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the length of school year.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Section 21.401, Education Code, is amended to

 1-4     read as follows:

 1-5           Sec. 21.401.  Minimum Service Required.  (A)  A contract

 1-6     between a school district and an educator must be for a minimum of

 1-7     10 months' service.

 1-8                       (B)  An educator employed under a 10-month

 1-9     contract must provide a minimum number of days of service as

1-10     determined by the following formula:

1-12           "M D S" is the minimum number of days of service;

1-13           "R1" is equal to FSP/ADA as determined under Section 21.402

1-14     for the 1996-1997 [1994-1995] school year.

1-15           (c)  The result of the formula prescribed by Subsection (b)

1-16     shall be rounded to the nearest whole number.

1-17           (d)  The commissioner as provided by Section 25.081(b), may

1-18     reduce the number of days of service required by this section.  A

1-19     reduction by the commissioner does not reduce an educator's salary.

1-20           SECTION 2.  This Act takes effect September 1, 1997.

1-21           SECTION 3.  The importance of this legislation and the

 2-1     crowded condition of the calendars in both houses create an

 2-2     emergency and an imperative public necessity that the

 2-3     constitutional rule requiring bills to be read on three several

 2-4     days in each house be suspended, and this rule is hereby suspended.
