 1-7                            A BILL TO BE ENTITLED

 1-8                                   AN ACT

 1-9     relating to the number of days of service required of certain

1-10     educators for the school year.

1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

1-12           SECTION 1.  Section 21.401, Education Code, is amended to

1-13     read as follows:

1-14           Sec. 21.401.  MINIMUM SERVICE REQUIRED.  (a)  A contract

1-15     between a school district and an educator must be for a minimum of

1-16     10 months' service.

1-17           (b)  An educator employed under a 10-month contract must

1-18     provide a minimum number of days of service as determined by the

1-19     following formula:

1-21     where:

1-22           "MDS" is the minimum number of days of service;

1-23           "R1" is equal to FSP/ADA as determined under Section 21.402

1-24     for the fiscal year; and

1-25           "R2" is equal to FSP/ADA as determined under Section 21.402

1-26     for the 1996-1997 [1994-1995] school year.

1-27           (b-1)  Subsection (b) applies beginning with the 1997-1998

1-28     school year.  This subsection expires January 1, 1998.

1-29           (c)  The result of the formula prescribed by Subsection (b)

1-30     shall be rounded to the nearest whole number.

1-31           (d)  The commissioner, as provided by Section 25.081(b), may

1-32     reduce the number of days of service required by this section.  A

1-33     reduction by the commissioner does not reduce an educator's salary.

1-34           SECTION 2.  This Act takes effect September 1, 1997.

1-35           SECTION 3.  The importance of this legislation and the

1-36     crowded condition of the calendars in both houses create an

1-37     emergency and an imperative public necessity that the

1-38     constitutional rule requiring bills to be read on three several

1-39     days in each house be suspended, and this rule is hereby suspended,

1-40     and that this Act take effect and be in force according to its

1-41     terms, and it is so enacted.
