                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to application by the Texas Department of Insurance of

 1-3     provisions adopted by the National Association of Insurance

 1-4     Commissioners.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Article 1.27, Insurance Code, is amended to read

 1-7     as follows:

 1-8           Art. 1.27.  APPLICATION OF PROVISIONS ADOPTED BY NATIONAL

 1-9     ASSOCIATION OF INSURANCE COMMISSIONERS.  The department may not

1-10     require an insurer to comply with any rule, regulation, directive,

1-11     or standard adopted by the National Association of Insurance

1-12     Commissioners unless application of the rule, regulation,

1-13     directive, or standard, including policy reserves, is expressly

1-14     authorized by a specific statute relating to the subject matter of

1-15     the rule, regulation, directive, or standard and is approved  by

1-16     the commissioner.

1-17           SECTION 2.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended,

1-22     and that this Act take effect and be in force from and after its

1-23     passage, and it is so enacted.
