A BILL TO BE ENTITLED
AN ACT
1-1 relating to the creation, administration, powers, duties,
1-2 operation, and financing of the Pine Island Bayou Stormwater
1-3 Control District; granting the authority to issue bonds and impose
1-4 taxes; granting the power of eminent domain.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. CREATION; LEGISLATIVE DECLARATION. (a) A
1-7 conservation and reclamation district to be known as the Pine
1-8 Island Bayou Stormwater Control District is created in Hardin,
1-9 Jefferson, and Liberty counties, subject to approval at a
1-10 confirmation election under Section 10 of this Act. The district
1-11 is a governmental agency and a body politic and corporate.
1-12 (b) The district is created under and is essential to the
1-13 accomplishment of the purposes of Section 59, Article XVI, Texas
1-14 Constitution.
1-15 SECTION 2. DEFINITION. In this Act, "district" means the
1-16 Pine Island Bayou Stormwater Control District.
1-17 SECTION 3. BOUNDARIES. (a) The district includes all of
1-18 the territory contained in the following described area:
1-19 BEING 446,912 acres of land lying in Jefferson County, Texas,
1-20 Hardin County, Texas and Liberty County, Texas and being described
1-21 by metes and bounds as follows;
1-22 BEGINNING at the intersection of State Highway 326, also known as
1-23 FM 365, and the Southern Pacific Railroad right-of-way, just east
1-24 of Nome, Texas in Jefferson County, Texas;
2-1 THENCE North 8150'East, with said Southern Pacific Railroad

2-3 the intersection of said Southern Pacific Railroad right-of-way and

29-18 (b) Boundaries of the district may be adjusted after a
29-19 benefit hearing as provided by Section 9 of this Act and before a
29-20 confirmation election is held as provided by Section 10 of this
29-21 Act.
29-22 SECTION 4. FINDINGS RELATING TO BOUNDARIES. The legislature
29-23 finds that the boundaries and field notes of the district form a
29-24 closure. If any mistake is made in the field notes or in copying
29-25 the field notes in the legislative process, it in no way affects
29-26 the organization, existence, and validity of the district, or the
29-27 right of the district to issue any type of bonds or refunding bonds
30-1 for the purposes for which the district is created or to pay the
30-2 principal of and interest on the bonds, or in any other manner
30-3 affects the legality or operation of the district or its governing
30-4 body.
30-5 SECTION 5. FINDING OF BENEFIT. All of the land and other
30-6 property included within the boundaries of the district will be
30-7 benefited by the works and projects that are to be accomplished by
30-8 the district under powers conferred by Section 59, Article XVI,
30-9 Texas Constitution. The district is created to serve a public use
30-10 and benefit.
30-11 SECTION 6. POWERS. (a) The district has all of the rights,
30-12 powers, privileges, authority, functions, and duties provided by
30-13 the general law of this state, including Chapters 49 and 66, Water
30-14 Code, applicable to stormwater control districts created under
30-15 Section 59, Article XVI, Texas Constitution. In addition, the
30-16 district has the rights, powers, privileges, authority, functions,
30-17 and duties provided by Chapter 56, Water Code. This Act prevails
30-18 over any provision of general law that is in conflict or
30-19 inconsistent with this Act. If there is a conflict between Chapter
30-20 56 and Chapter 66, Water Code, Chapter 66 prevails.
30-21 (b) The rights, powers, privileges, authority, functions,
30-22 and duties of the district are subject to the continuing right of
30-23 supervision of the state to be exercised by and through the Texas
30-24 Natural Resource Conservation Commission.
30-25 SECTION 7. BOARD OF DIRECTORS. (a) The district is
30-26 governed by a board of seven directors.
30-27 (b) Temporary directors serve until initial directors are
31-1 elected under Section 10 of this Act.
31-2 (c) Initial directors serve until permanent directors are
31-3 elected under Section 11 of this Act.
31-4 (d) Permanent directors serve staggered four-year terms.
31-5 (e) Each director must qualify to serve as director in the
31-6 manner provided by Section 49.055, Water Code.
31-7 SECTION 8. TEMPORARY DIRECTORS. (a) The temporary board of
31-8 directors is composed of:
31-9 (1) Warren Johnson;
31-10 (2) Norman Lowery;
31-11 (3) Claire Mason;
31-12 (4) Kenneth McFarland;
31-13 (5) Jeanie Turk;
31-14 (6) Burt Shivers; and
31-15 (7) Paul Fontenot.
31-16 (b) If a temporary director fails to qualify for office, the
31-17 temporary directors who have qualified shall appoint a person to
31-18 fill the vacancy. If at any time there are fewer than seven
31-19 qualified temporary directors for any other reason, the Texas
31-20 Natural Resource Conservation Commission shall appoint the
31-21 necessary number of persons to fill all vacancies on the board.
31-22 (c) As soon as all temporary directors have qualified, the
31-23 directors shall meet and elect a chairman and vice chairman from
31-24 among their membership and other officers as necessary.
31-25 SECTION 9. BENEFIT HEARING; APPEAL. (a) As soon as
31-26 practicable after all temporary directors have qualified and
31-27 officers have been elected as provided by Section 8 of this Act,
32-1 the temporary board of directors shall set a date for a hearing to
32-2 determine whether the land to be included in the district will be
32-3 benefited by the creation of the district.
32-4 (b) After a date is set for the hearing, the temporary board
32-5 of directors shall give notice of the hearing and shall hold the
32-6 hearing and issue an order stating its final decision in the manner
32-7 provided by Chapter 2001, Government Code. In addition to other
32-8 notice required by law, the temporary board of directors shall
32-9 publish notice in a newspaper with general circulation in the area
32-10 of the district once a week for two consecutive weeks, the first
32-11 publication to be made at least 30 days before the date set for the
32-12 hearing.
32-13 (c) After the hearing, if the temporary board of directors
32-14 finds that the creation of the district will be a benefit to land
32-15 included in the district, the temporary board of directors shall
32-16 make that finding and by order shall confirm the boundaries of the
32-17 district as described in Section 3 of this Act.
32-18 (d) In making its decision, if the temporary board of
32-19 directors finds that a part of the land to be included in the
32-20 district will not be benefited by creation of the district, the
32-21 temporary board of directors shall make this finding and by order
32-22 exclude the nonbenefited land from the proposed district and redraw
32-23 the boundaries of the district to conform to this change.
32-24 (e) The temporary board of directors shall mail to the Texas
32-25 Natural Resource Conservation Commission the order confirming or
32-26 redrawing the boundaries of the district.
32-27 (f) The order of the temporary board of directors confirming
33-1 or redrawing the boundaries of the district may be appealed as
33-2 provided by Chapter 2001, Government Code.
33-3 SECTION 10. CONFIRMATION AND INITIAL DIRECTORS' ELECTION.
33-4 (a) After a hearing has been held and the temporary board of
33-5 directors has confirmed or redrawn the boundaries of the district
33-6 as provided by Section 9 of this Act, the temporary board of
33-7 directors shall call and hold an election to confirm establishment
33-8 of the district and to elect seven initial directors as provided by
33-9 Chapter 49, Water Code.
33-10 (b) Subsection (a), Section 41.001, Election Code, does not
33-11 apply to a confirmation election held as provided by this section.
33-12 SECTION 11. ELECTION OF DIRECTORS. (a) On the first
33-13 Saturday in May of the first even-numbered year after the year in
33-14 which the confirmation election is held, an election shall be held
33-15 in the district for the election at large of three directors who
33-16 shall each serve two-year terms and four directors who shall each
33-17 serve four-year terms. Thereafter, on the same date in each
33-18 subsequent even-numbered year, the appropriate number of directors
33-19 shall be elected to the board.
33-20 (b) The directors elected at the election described in
33-21 Subsection (a) of this section may assign a position number to each
33-22 director's seat, after which directors shall be elected by
33-23 position.
33-24 SECTION 12. ADDITIONAL POWERS. (a) The district as a
33-25 stormwater control district may issue bonds to provide for all
33-26 improvements and the maintenance of those improvements necessary to
33-27 achieve the purposes of Section 59, Article XVI, Texas
34-1 Constitution, and may provide for the payment of the bonds through
34-2 ad valorem taxes and revenues collected for that purpose as
34-3 authorized by Chapter 66, Water Code.
34-4 (b) The district may acquire land, materials, waste grounds,
34-5 easements, rights-of-way, and everything considered necessary for
34-6 the purpose of accomplishing any one or more of the authorized
34-7 functions of the district.
34-8 (c) The district shall have the right to acquire property by
34-9 gift, grant, or purchase, and the right to acquire property shall
34-10 include property considered necessary for the construction,
34-11 improvement, extension, enlargement, operation, or maintenance of
34-12 the plants, works, improvements, facilities, equipment, or
34-13 appliances of the district.
34-14 (d) The district may acquire either the fee simple title to
34-15 or an easement on all land, both public and private, either inside
34-16 or outside the boundaries and may acquire the title to or an
34-17 easement on property other than land held in fee.
34-18 (e) The district may also lease property on terms and
34-19 conditions the board of directors determines to be advantageous to
34-20 the construction, improvement, extension, enlargement, operation,
34-21 or maintenance of the plants, works, improvements, facilities,
34-22 equipment, or appliances of the district.
34-23 (f) The district may acquire either the fee simple title to
34-24 or an easement on all land, both public and private, either inside
34-25 or outside the boundaries and may acquire the title to or an
34-26 easement on property other than land held in fee.
34-27 (g) The district may also lease property on terms and
35-1 conditions the board of directors determines to be advantageous to
35-2 the district.
35-3 (h) The district may acquire any land, easements, or other
35-4 property inside the district or within five miles of the district
35-5 solely for sewer, water, storm drainage, and flood drainage
35-6 connections when necessary by condemnation and may elect to condemn
35-7 either the fee simple title or an easement only.
35-8 SECTION 13. FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.
35-9 (a) The proper and legal notice of the intention to introduce this
35-10 Act, setting forth the general substance of this Act, has been
35-11 published as provided by law, and the notice and a copy of this Act
35-12 have been furnished to all persons, agencies, officials, or
35-13 entities to which they are required to be furnished by the
35-14 constitution and other laws of this state, including the governor,
35-15 who has submitted the notice and Act to the Texas Natural Resource
35-16 Conservation Commission.
35-17 (b) The Texas Natural Resource Conservation Commission has
35-18 filed its recommendations relating to this Act with the governor,
35-19 lieutenant governor, and speaker of the house of representatives
35-20 within the required time.
35-21 (c) All requirements of the constitution and laws of this
35-22 state and the rules and procedures of the legislature with respect
35-23 to the notice, introduction, and passage of this Act are fulfilled
35-24 and accomplished.
35-25 SECTION 14. EMERGENCY. The importance of this legislation
35-26 and the crowded condition of the calendars in both houses create an
35-27 emergency and an imperative public necessity that the
36-1 constitutional rule requiring bills to be read on three several
36-2 days in each house be suspended, and this rule is hereby suspended,
36-3 and that this Act take effect and be in force from and after its
36-4 passage, and it is so enacted.
