                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the creation, administration, powers, duties,

 1-3     operation, and financing of the Pine Island Bayou Stormwater

 1-4     Control District.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  CREATION; LEGISLATIVE DECLARATION.  (a)  A

 1-7     Conservation and reclamation district is created in Hardin,

 1-8     Jefferson and Liberty Counties to be known as the Pine Island Bayou

 1-9     Stormwater Control District, subject to approval at a confirmation

1-10     election under Section 9 of this Act.  The district is a

1-11     governmental agency and a body politic and corporate.

1-12           (b)  The creation of the District is declared to be essential

1-13     to the accomplishment of the purposes of Article XVI, Section 59 of

1-14     the Texas Constitution.

1-15           SECTION 2.  DEFINITION.  In this Act, "district" means the

1-16     Pine Island Bayou Stormwater Control District.

1-17           SECTION 3.  BOUNDARIES.  (a)  The district shall include all

1-18     of the territory contained within the following described area:

1-19     BEING 446,912 acres of land lying in Jefferson County, Texas,

1-20     Hardin County, Texas and Liberty County, Texas and being described

1-21     by metes and bounds as follows;

1-22     BEGINNING at the intersection of State Highway 326, also known as

1-23     FM 365, and the Southern Pacific Railroad right-of-way, just east

1-24     of Nome, Texas in Jefferson County, Texas;

 2-1     THENCE North 8150'East, with said Southern Pacific Railroad

 2-2     right-of-way an approximate distance of 18651 feet to a point at

 2-3     the intersection of said Southern Pacific Railroad right-of-way and

 2-4     the Lower Neches Valley Authority Canal;

29-18          (b)  boundaries of the district may be adjusted after a

29-19    benefits hearing as provided by Section 8 of this Act and before a

29-20    confirmation election is held as provided by Section 9 of this Act.

29-21          SECTION 4.  FINDINGS RELATING TO BOUNDARIES.  The legislature

29-22    finds that the boundaries and field notes of the district form a

29-23    closure.  If any mistake is made in the field notes or in copying

29-24    the field notes in the legislative process, it in no way affects

29-25    the organization, existence, and validity of the district, or the

29-26    right of the district to issue any type of bonds or refunding bonds

29-27    for the purposes for which the district is created or to pay the

 30-1    principal of and interest on the bonds, or in any other manner

 30-2    affects the legality or operation of the district or its governing

 30-3    body.

 30-4          SECTION 5.  FINDING OF BENEFIT.  All of the land and other

 30-5    property included within the boundaries of the district will be

 30-6    benefited by the works and projects that are to be accomplished by

 30-7    the district under powers conferred by Section 59, Article XVI,

 30-8    Texas Constitution.  The district is created to serve a public use

 30-9    and benefit.

30-10          SECTION 6.  POWERS.  (a)  The district has all of the rights,

30-11    powers, privileges, authority, functions, and duties provided by

30-12    Code, applicable to stormwater control districts created under

30-13    Section 59, Article XVI, Texas Constitution.  In addition, the

30-14    district has the rights, powers, privileges, authority, functions

30-15    and duties provided by Chapter 56, Water Code.  This Act prevails

30-16    over any provision of general law that is in conflict or

30-17    inconsistent with this Act.  If there is a conflict between Chapter

30-18    56 and Chapter 66, Water Code, Chapter 66 prevails.

30-19          (b)  The rights, powers, privileges, authority, functions,

30-20    and duties of the district are subject to the continuing right of

30-21    supervision of the state to be exercised by and through the Texas

30-22    Natural Resource Conservation Commission.

30-23          (c)  The district as a stormwater control district shall

30-24    issues bonds to provide for all improvements in the maintenance

30-25    thereof requisite to achieve the purposes of Article XVI, Section

30-26    59 of the Texas Constitution which such bonds may be paid through

30-27    ad valorem tax and revenues collected for the repayment of such

 31-1    bonds as authorized by Chapter 66 of the Texas Water Code.

 31-2          SECTION 7.  BOARD OF DIRECTORS.  (a)  The district is

 31-3    governed by a board of seven (7) directors.

 31-4          (b)  Except for the initial directors, each director shall

 31-5    serve for the term of office provided for directors under Chapter

 31-6    49, Water Code, and until his successor is elected and has

 31-7    qualified.

 31-8          (c)  Each director shall qualify to serve as director in the

 31-9    manner provided by Chapter 49, Water Code.

31-10          (d)  At the time this Act takes effect, the following persons

31-11    shall constitute the initial board of directors of the district:

31-12                (1)  Warren Johnson

31-13                (2)  Norman Lowery

31-14                (3)  Claire Mason

31-15                (4)  Kenneth McFarland

31-16                (5)  Jeanie Turk

31-17                (6)  Burt Shivers

31-18                (7)  Paul Fontenot

31-19          (e)  If any of the directors listed in Subsection (d) of this

31-20    section fails to qualify for office, the remaining directors shall

31-21    appoint someone to fill the vacancy for the unexpired term.  If at

31-22    any time the number of qualified directors is less than seven (7)

31-23    because of the failure or refusal of one or more directors to

31-24    qualify to serve, because of death or incapacitation, or for any

31-25    other reason, the Texas Natural Resource Conservation Commission

31-26    shall appoint the necessary number of directors to fill all

31-27    vacancies on the board.

 32-1          (f)  The initial directors shall serve until permanent

 32-2    directors are elected as provided by Section 8 of this Act and

 32-3    Chapter 65, Water Code.

 32-4          SECTION 8.  CONFIRMATION AND DIRECTORS' ELECTION.  An

 32-5    election shall be called and held to confirm establishment of the

 32-6    district and to elect seven permanent directors as provided by

 32-7    Chapter 49, Water Code.

 32-8          SECTION 9.  ELECTION OF DIRECTORS.  Beginning in the first

 32-9    even-numbered year following the confirmation and directors'

32-10    election, an election shall be held on the uniform election day

32-11    established by the Election Code in May to elect the appropriate

32-12    number of directors to the board.  The permanent directors may

32-13    assign a position number to each director's office, in which case,

32-14    directors shall thereafter be elected by position and not at large.

32-15          SECTION 10.  BENEFIT HEARING; APPEAL.  (a)  As soon as

32-16    practicable after all temporary directors have qualified and

32-17    officers have been elected as provided by Section 7, the temporary

32-18    board of directors shall set a date for a hearing to determine

32-19    whether the land to included in the district will be benefited by

32-20    the creation of the district.

32-21          (b)  After a date is set for the hearing, the temporary board

32-22    of directors shall give notice of the hearing and shall hold the

32-23    hearing and issue an order stating its final decision in the manner

32-24    provided by Chapter 2001, Government Code.  In addition to other

32-25    notice required by law, the temporary board of directors shall

32-26    publish notice in a newspaper with general circulation in the area

32-27    of the district once a week for two consecutive weeks, the first

 33-1    publication to be made at least 30 days before the date set for the

 33-2    hearing.

 33-3          (c)  After the hearing, if the temporary board of directors

 33-4    finds that the creation of the district will be a benefit to land

 33-5    included in the district, the temporary board of directors shall

 33-6    make that finding and by order shall confirm the boundaries of the

 33-7    district as described in Section 3.

 33-8          (d)  In making its decision, if the temporary board of

 33-9    directors finds that a part of the land to be included in the

33-10    district will not be benefited by creation of the district, the

33-11    temporary board of directors shall make this finding and by order

33-12    exclude the nonbenefited land from the proposed district and redraw

33-13    the boundaries of the district to conform to this change.

33-14          (e)  The temporary board of directors shall mail to the Texas

33-15    Natural Resource Conservation Commission the order confirming or

33-16    redrawing the boundaries of the district.

33-17          (f)  The order of the temporary board of directors confirming

33-18    or redrawing the boundaries of the district may be appealed as

33-19    provided by Chapter 200, Government Code.

33-20          SECTION 11.  ADDITIONAL POWERS.  (a)  The district may

33-21    acquire land, materials, waste grounds, easements, rights-of-way,

33-22    and everything considered necessary for the purpose of

33-23    accomplishing any one or more of the authorized functions of the

33-24    district.

33-25          (b)  The district shall have the right to acquire property by

33-26    gift, grant, or purchase and the right to acquire property shall

33-27    include property considered necessary for the construction,

 34-1    improvement, extension, enlargement, operation, or maintenance of

 34-2    the plants, works, improvements, facilities, equipment, or

 34-3    appliances of the district.

 34-4          (c)  The district may acquire either the fee simple title to

 34-5    or an easement on all land, both public and private, either inside

 34-6    or outside the boundaries and may acquire the title to or an

 34-7    easement on property other than land held in fee.

 34-8          (d)  The district may also lease property on terms and

 34-9    conditions the board of directors determines to be advantageous to

34-10    the district.

34-11          (e)  The district may acquire any land, easements, or other

34-12    property inside the district or within five miles of the district

34-13    solely for sewer, water, storm drainage, and flood drainage

34-14    connections when necessary by condemnation, and may elect to

34-15    condemn either the fee simple title or an easement only.

34-16          SECTION 12.  FINDINGS RELATING TO PROCEDURAL REQUIREMENTS.

34-17    (a)  The proper and legal notice of the intention to introduce this

34-18    Act, setting forth the general substance of this Act, has been

34-19    published as provided by law, and the notice and a copy of this Act

34-20    have been furnished to all persons, agencies, officials, or

34-21    entities to which they are required to be furnished by the

34-22    constitution and other laws of this state, including the governor,

34-23    who has submitted the notice and Act to the Texas Natural Resource

34-24    Conservation Commission.

34-25          (b)  The Texas Natural Resource Conservation Commission has

34-26    filed its recommendations relating to this Act with the governor,

34-27    lieutenant governor, and speaker of the house of representatives

 35-1    within the required time.

 35-2          (c)  All requirements of the constitution and laws of this

 35-3    state and the rules and procedures of the legislature with respect

 35-4    to the notice, introduction, and passage of this Act are fulfilled

 35-5    and accomplished.

 35-6          SECTION 13.  EMERGENCY CLAUSE.  The importance of this

 35-7    legislation and the crowded condition of the calendars in both

 35-8    houses create an emergency and an imperative public necessity that

 35-9    the constitutional rule requiring bills to be read on three several

35-10    days in each house be suspended, and this rule is hereby suspended,

35-11    and that this Act take effect and be in force from and after its

35-12    passage, and it is so enacted.
