                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to the acceptance of gifts, grants, and donations by the

 1-2     secretary of state.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter A, Chapter 405, Government Code, is

 1-5     amended by adding Section 405.005 to read as follows:

 1-6           Sec. 405.005.  ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS.

 1-7     (a)  The secretary of state may accept or solicit gifts, grants,

 1-8     and donations of money or property on behalf of the state for any

 1-9     lawful public purpose related to the office or duties of the

1-10     secretary of state.

1-11           (b)  The secretary of state may decline to accept a gift,

1-12     grant, or donation that is made for a specific purpose if the

1-13     secretary of state determines the gift may not be used reasonably

1-14     or economically for the designated purpose.

1-15           SECTION 2.  The importance of this legislation and the

1-16     crowded condition of the calendars in both houses create an

1-17     emergency and an imperative public necessity that the

1-18     constitutional rule requiring bills to be read on three several

1-19     days in each house be suspended, and this rule is hereby suspended,

1-20     and that this Act take effect and be in force from and after its

1-21     passage, and it is so enacted.
