No. 1903 1-2 (In the Senate - Filed March 21, 1997; March 25, 1997, read 1-3 first time and referred to Committee on State Affairs; 1-4 April 10, 1997, reported favorably by the following vote: Yeas 13, 1-5 Nays 0; April 10, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the acceptance of gifts, grants, and donations by the 1-9 secretary of state. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter A, Chapter 405, Government Code, is 1-12 amended by adding Section 405.005 to read as follows: 1-13 Sec. 405.005. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS. 1-14 (a) The secretary of state may accept or solicit gifts, grants, 1-15 and donations of money or property on behalf of the state for any 1-16 lawful public purpose related to the office or duties of the 1-17 secretary of state. 1-18 (b) The secretary of state may decline to accept a gift, 1-19 grant, or donation that is made for a specific purpose if the 1-20 secretary of state determines the gift may not be used reasonably 1-21 or economically for the designated purpose. 1-22 SECTION 2. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 1-25 constitutional rule requiring bills to be read on three several 1-26 days in each house be suspended, and this rule is hereby suspended, 1-27 and that this Act take effect and be in force from and after its 1-28 passage, and it is so enacted. 1-29 * * * * *
