AN ACT

 1-1     relating to hazardous liquid or carbon dioxide pipeline facilities.

 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-3           SECTION 1.  Section 117.011, Natural Resources Code, is

 1-4     amended to read as follows:

 1-5           Sec. 117.011.  JURISDICTION.  (a)  The commission has

 1-6     jurisdiction over all pipeline transportation of hazardous liquids

 1-7     or carbon dioxide and over all hazardous liquid or carbon dioxide

 1-8     pipeline facilities as provided by 49 U.S.C. Section 60101 et seq

 1-9     [in the Hazardous Liquid Pipeline Safety Act of 1979 (Pub.L. No.

1-10     96-129)].

1-11           (b)  The commission may seek designation by the United States

1-12     secretary of transportation as an agent to conduct safety

1-13     inspections of interstate hazardous liquid or carbon dioxide

1-14     pipeline facilities located in this state.

1-15           SECTION 2.  Section 117.012, Natural Resources Code, is

1-16     amended by adding Subsection (g) to read as follows:

1-17           (g)  The commission shall adopt rules regarding:

1-18                 (1)  public education and awareness concerning

1-19     hazardous liquid or carbon dioxide pipeline facilities; and

1-20                 (2)  community liaison for the purpose of responding to

1-21     an emergency concerning a hazardous liquid or carbon dioxide

1-22     pipeline facility.

1-23           SECTION 3.  The importance of this legislation and the

 2-1     crowded condition of the calendars in both houses create an

 2-2     emergency and an imperative public necessity that the

 2-3     constitutional rule requiring bills to be read on three several

 2-4     days in each house be suspended, and this rule is hereby suspended,

 2-5     and that this Act take effect and be in force from and after its

 2-6     passage, and it is so enacted.
