No. 1929 1-2 (In the Senate - Filed April 16, 1997; April 16, 1997, read 1-3 first time and referred to Committee on Natural Resources; 1-4 April 18, 1997, reported favorably by the following vote: Yeas 8, 1-5 Nays 0; April 18, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the disposal of certain solid waste and permits for 1-9 disposal of that waste. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter C, Chapter 361, Health and Safety 1-12 Code, is amended by adding Section 361.116 to read as follows: 1-13 Sec. 361.116. INCIDENTAL INJECTION WELL WASTES. The 1-14 commission shall adopt rules regulating the disposal of solid waste 1-15 generated incidentally by the operation of an injection well 1-16 permitted for the disposal of waste. The rules must be consistent 1-17 with federal law and rules of the United States Environmental 1-18 Protection Agency. 1-19 SECTION 2. Subchapter C, Chapter 361, Health and Safety 1-20 Code, is amended by adding Section 361.0895 to read as follows: 1-21 Sec. 361.0895. FACILITIES REQUIRED TO OBTAIN FEDERAL 1-22 APPROVAL. The commission by rule shall develop separate standards 1-23 for the fixed term of a permit and for the cancellation, 1-24 modification, amendment, revocation, or renewal of a permit for a 1-25 solid waste management facility that is required to obtain separate 1-26 approval from the United States Environmental Protection Agency. 1-27 SECTION 3. Subchapter D, Chapter 27, Water Code, is amended 1-28 by adding Section 27.0515 to read as follows: 1-29 Sec. 27.0515. FACILITIES REQUIRED TO OBTAIN FEDERAL 1-30 APPROVAL. The commission by rule shall develop separate standards 1-31 for the fixed term of a permit and for the cancellation, 1-32 modification, amendment, revocation, or renewal of a permit for an 1-33 injection well permitted for the disposal of solid waste if the 1-34 facility is required to obtain separate approval from the United 1-35 States Environmental Protection Agency. 1-36 SECTION 4. This Act takes effect September 1, 1997. 1-37 SECTION 5. The importance of this legislation and the 1-38 crowded condition of the calendars in both houses create an 1-39 emergency and an imperative public necessity that the 1-40 constitutional rule requiring bills to be read on three several 1-41 days in each house be suspended, and this rule is hereby suspended. 1-42 * * * * *
