                                A BILL TO BE ENTITLED

                                       AN ACT

 1-1     relating to limiting the area that may be included in the

 1-2     extraterritorial jurisdiction of certain municipalities.

 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Subchapter B, Local Government Code, is amended

 1-5     by adding Section 42.026 to read as follows:

 1-6           Sec. 42.026.  LIMITATION ON EXTRATERRITORIAL JURISDICTION OF

 1-7     CERTAIN MUNICIPALITIES.  (a)  This section applies only to a

 1-8     home-rule municipality located in whole or in part in a county with

 1-9     a population of 240,000 or less.

1-10           (b)  The extraterritorial jurisdiction of the municipality

1-11     does not include territory:

1-12                 (1)  located outside the county in which a majority of

1-13     the land area of the municipality is located; and

1-14                 (2)  located in a county with a population of 70,000 or

1-15     less.

1-16           SECTION 2.  This Act takes effect September 1, 1997.

1-17           SECTION 3.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
