No. 1943 1-2 (In the Senate - Filed May 1, 1997; May 2, 1997, read first 1-3 time and referred to Committee on Natural Resources; May 9, 1997, 1-4 reported favorably by the following vote: Yeas 9, Nays 0; 1-5 May 9, 1997, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to validating the creation and certain actions of the 1-9 Comal County Fresh Water Supply District No. 1. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. DEFINITION. In this Act, "district" means the 1-12 Comal County Fresh Water Supply District No. 1. 1-13 SECTION 2. CREATION OF DISTRICT CONFIRMED. The creation of 1-14 the district is confirmed and validated in all respects. 1-15 SECTION 3. LEGISLATIVE DECLARATION. The legislature 1-16 declares that: 1-17 (1) the district validly exists and operates under 1-18 Section 59, Article XVI, Texas Constitution; 1-19 (2) all land and other property in the district are 1-20 benefited by the district and the facilities and improvements to be 1-21 constructed or acquired by the district; 1-22 (3) the district is essential to accomplish the 1-23 purposes of Section 59, Article XVI, Texas Constitution; and 1-24 (4) the district is a governmental agency and body 1-25 politic. 1-26 SECTION 4. VALIDATION OF ACTIONS AND PROCEEDINGS. The 1-27 legislature validates and confirms: 1-28 (1) the boundaries of the district as provided by 1-29 order of the district's board of supervisors adopted on June 27, 1-30 1996; 1-31 (2) the election held in the district on May 6, 1995, 1-32 including all proceedings related to the election; 1-33 (3) all district bonds issued or authorized before the 1-34 effective date of this Act and all proceedings related to their 1-35 issuance or authorization; and 1-36 (4) each governmental proceeding or act performed by 1-37 the district's board of supervisors or an officer of the district 1-38 before the effective date of this Act, as of the date of the 1-39 proceeding or act. 1-40 SECTION 5. APPLICABILITY. This Act does not apply to a 1-41 person who is the subject of litigation pending on the effective 1-42 date of this Act or to any matter the validity of which is the 1-43 subject of litigation pending on the effective date of this Act. 1-44 SECTION 6. EMERGENCY. The importance of this legislation 1-45 and the crowded condition of the calendars in both houses create an 1-46 emergency and an imperative public necessity that the 1-47 constitutional rule requiring bills to be read on three several 1-48 days in each house be suspended, and this rule is hereby suspended, 1-49 and that this Act take effect and be in force from and after its 1-50 passage, and it is so enacted. 1-51 * * * * *
