No. 28 SENATE CONCURRENT RESOLUTION 1-1 WHEREAS, The University of Texas System, for internal 1-2 purposes, investigates allegations of abuse, neglect, and 1-3 exploitation of patients served by psychiatric facilities located 1-4 in hospitals operated by The University of Texas System and its 1-5 component universities or health science centers; and 1-6 WHEREAS, The Texas Department of Health, through its Medicare 1-7 accreditation process, also investigates allegations of abuse, 1-8 neglect, and exploitation of patients served by these facilities; 1-9 and 1-10 WHEREAS, The Senate Health and Human Services Committee found 1-11 that, though both The University of Texas System and the Texas 1-12 Department of Health conduct these investigations, neither provides 1-13 data relating to the investigations to the Texas Legislature; and 1-14 WHEREAS, To conduct proper oversight, it is important that 1-15 the legislature receive reliable and complete information relating 1-16 to investigations of alleged abuse, neglect, and exploitation; now, 1-17 therefore, be it 1-18 RESOLVED, That the 75th Legislature of the State of Texas 1-19 hereby direct The University of Texas System, in cooperation with 1-20 its component universities and hospitals, to provide an annual 1-21 report to the governor, lieutenant governor, speaker of the house 1-22 of representatives, and Senate Health and Human Services Committee 1-23 regarding investigations of allegations of abuse, neglect, and 2-1 exploitation of patients at psychiatric facilities located in 2-2 hospitals operated by The University of Texas System or any of its 2-3 component universities or health science centers; and, be it 2-4 further 2-5 RESOLVED, That the report include, at a minimum: 2-6 (1) the number of investigations conducted at each 2-7 facility, by classification as defined by rules adopted by the 2-8 Texas Department of Mental Health and Mental Retardation; 2-9 (2) the number of serious physical injuries sustained 2-10 by patients at each facility; 2-11 (3) the average number of days required to complete an 2-12 investigation at each facility; 2-13 (4) the number of investigations referred by each 2-14 facility to law enforcement agencies; and 2-15 (5) the number of confirmed cases at each facility, by 2-16 classification as defined by rules adopted by the Texas Department 2-17 of Mental Health and Mental Retardation; and, be it further 2-18 RESOLVED, That the secretary of state forward an official 2-19 copy of this resolution to The University of Texas System.
