No. 28 1-2 (In the Senate - Filed February 19, 1997; February 24, 1997, 1-3 read first time and referred to Committee on Health and Human 1-4 Services; March 5, 1997, reported favorably by the following vote: 1-5 Yeas 11, Nays 0; March 5, 1997, sent to printer.) 1-6 SENATE CONCURRENT RESOLUTION 1-7 WHEREAS, The University of Texas System, for internal 1-8 purposes, investigates allegations of abuse, neglect, and 1-9 exploitation of patients served by psychiatric facilities located 1-10 in hospitals operated by The University of Texas System and its 1-11 component universities or health science centers; and 1-12 WHEREAS, The Texas Department of Health, through its Medicare 1-13 accreditation process, also investigates allegations of abuse, 1-14 neglect, and exploitation of patients served by these facilities; 1-15 and 1-16 WHEREAS, The Senate Health and Human Services Committee found 1-17 that, though both The University of Texas System and the Texas 1-18 Department of Health conduct these investigations, neither provides 1-19 data relating to the investigations to the Texas Legislature; and 1-20 WHEREAS, To conduct proper oversight, it is important that 1-21 the legislature receive reliable and complete information relating 1-22 to investigations of alleged abuse, neglect, and exploitation; now, 1-23 therefore, be it 1-24 RESOLVED, That the 75th Legislature of the State of Texas 1-25 hereby direct The University of Texas System, in cooperation with 1-26 its component universities and hospitals, to provide an annual 1-27 report to the governor, lieutenant governor, speaker of the house 1-28 of representatives, and Senate Health and Human Services Committee 1-29 regarding investigations of allegations of abuse, neglect, and 1-30 exploitation of patients at psychiatric facilities located in 1-31 hospitals operated by The University of Texas System or any of its 1-32 component universities or health science centers; and, be it 1-33 further 1-34 RESOLVED, That the report include, at a minimum: 1-35 (1) the number of investigations conducted at each 1-36 facility, by classification as defined by rules adopted by the 1-37 Texas Department of Mental Health and Mental Retardation; 1-38 (2) the number of serious physical injuries sustained 1-39 by patients at each facility; 1-40 (3) the average number of days required to complete an 1-41 investigation at each facility; 1-42 (4) the number of investigations referred by each 1-43 facility to law enforcement agencies; and 1-44 (5) the number of confirmed cases at each facility, by 1-45 classification as defined by rules adopted by the Texas Department 1-46 of Mental Health and Mental Retardation; and, be it further 1-47 RESOLVED, That the secretary of state forward an official 1-48 copy of this resolution to The University of Texas System. 1-49 * * * * *
