SENATE CONCURRENT RESOLUTION

 1-1           WHEREAS, Senate Bill No. 1 has been adopted by the senate and

 1-2     the house of representatives and is being prepared for enrollment;

 1-3     and

 1-4           WHEREAS, The bill contains technical errors that need

 1-5     correction; now, therefore, be it

 1-6           RESOLVED, That the enrolling clerk of the senate be

 1-7     instructed to correct Senate Bill No. 1 as follows:

 1-8           (1)  In SECTION 2.08 of the bill, in Paragraph (F),

 1-9     Subdivision (2), Subsection (k), Section 11.085, Water Code, as

1-10     added by the bill (Conference Committee Report, page 33, line 24),

1-11     between "existing" and "instream", insert "water rights,".

1-12           (2)  In SECTION 2.08 of the bill, in Subsection (v), Section

1-13     11.085, Water Code, as added by the bill (Conference Committee

1-14     Report, page 36, line 17), strike "This section does" and

1-15     substitute, "The provisions of this section, except Subsection (a),

1-16     do".

1-17           (3)  In SECTION 3.02 of the bill, in Subsection (b), Section

1-18     11.0842, Water Code, as added by the bill (Conference Committee

1-19     Report, page 47, line 16) strike "or Section 16.236 of this code"

1-20     and add the following after the first sentence of the subsection

1-21     (Conference Committee Report, page 47, line 18), "The penalty may

1-22     be in an amount not to exceed $1,000 for each day the person is in

1-23     violation of the rule or order adopted under Section 16.236 of this

 2-1     code."
