SENATE JOINT RESOLUTION

 1-1     proposing a constitutional amendment relating to the purposes for

 1-2     which money in the compensation to victims of crime fund and the

 1-3     compensation to victims of crime auxiliary fund may be used.

 1-4           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-5           SECTION 1.  Article I, Texas Constitution, is amended by

 1-6     adding Section 31 to read as follows:

 1-7           Sec. 31.  (a)  The compensation to victims of crime fund

 1-8     created by general law and the compensation to victims of crime

 1-9     auxiliary fund created by general law are each a separate dedicated

1-10     account in the general revenue fund.

1-11           (b)  Except as provided by Subsection (c) of this section and

1-12     subject to legislative appropriation, money deposited to the credit

1-13     of the compensation to victims of crime fund or the compensation to

1-14     victims of crime auxiliary fund from any source may be expended as

1-15     provided by law only for delivering or funding victim-related

1-16     compensation, services, or assistance.

1-17           (c)  The legislature may provide by law that money in the

1-18     compensation to victims of crime fund or in the compensation to

1-19     victims of crime auxiliary fund may be expended for the purpose of

1-20     assisting victims of episodes of mass violence if other money

1-21     appropriated for emergency assistance is depleted.

1-22           SECTION 2.  The following temporary provision is added to the

1-23     Texas Constitution:

 2-1           TEMPORARY PROVISION.  (a)  This temporary provision applies

 2-2     to the constitutional amendment proposed by S.J.R. No. 33, 75th

 2-3     Legislature, Regular Session, 1997, and expires January 2, 1998.

 2-4           (b)  The amendment to Article I of this constitution takes

 2-5     effect January 1, 1998.

 2-6           SECTION 3.  This proposed constitutional amendment shall be

 2-7     submitted to the voters at an election to be held November 4, 1997.

 2-8     The ballot shall be printed to permit voting for or against the

 2-9     proposition:  "The constitutional amendment designating the

2-10     purposes for which money in the compensation to victims of crime

2-11     fund and the compensation to victims of crime auxiliary fund may be

2-12     used."
