No. 33 SENATE JOINT RESOLUTION 1-1 proposing a constitutional amendment relating to the dedication of 1-2 the compensation to victims of crime fund and the compensation to 1-3 victims of crime auxiliary fund. 1-4 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Article I of the Texas Constitution is amended by 1-6 adding Section 31 to read as follows: 1-7 Sec. 31. (a) The compensation to victims of crime fund and 1-8 the compensation to victims of crime auxiliary fund created at 1-9 Chapter 56, Code of Criminal Procedure, is a dedicated fund in the 1-10 state treasury. 1-11 (b) Subject to legislative appropriation and except as 1-12 provided by Subsection (c) of this section, monies deposited to the 1-13 credit of the compensation to victims of crime fund and the 1-14 compensation to victims of crime auxiliary fund, from whatever 1-15 source, may be expended only for the purposes of compensating 1-16 victims of crime and for providing services to victims of crime, as 1-17 provided by law. 1-18 (c) In the event of an episode of mass violence, the 1-19 Legislative Budget Board is authorized to expend monies deposited 1-20 to the credit of the compensation to victims of crime fund and the 1-21 compensation to victims of crime auxiliary fund for purposes of 1-22 assisting such victims, but only if monies appropriated for 1-23 purposes of providing emergency assistance, as authorized under 1-24 other state law, are depleted. 2-1 SECTION 2. EFFECTIVE DATE. This Amendment takes effect on 2-2 January 1, 1998. 2-3 SECTION 3. This proposed constitutional amendment shall be 2-4 submitted to the voters at an election to be held November 4, 1997. 2-5 The ballot shall be printed to permit voting for or against the 2-6 proposition: "The constitutional amendment dedicating the 2-7 compensation to victims of crime fund and the compensation to 2-8 victims of crime auxiliary fund."
