                                 A JOINT RESOLUTION

 1-1     proposing a constitutional amendment relating to the rights of the

 1-2     defendant in a criminal case.

 1-3           BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-4           SECTION 1.  Article I, Texas Constitution, is amended by

 1-5     adding Section 31 to read as follows:

 1-6           Sec. 31.  The constitutional rights granted to criminal

 1-7     defendants by Sections 9, 10, 13, 14, and 19 of this article may

 1-8     not be construed as granting those defendants rights greater than

 1-9     those provided criminal defendants by the United States

1-10     Constitution, as the United States Constitution is construed by the

1-11     United States Supreme Court.

1-12           SECTION 2.  This proposed constitutional amendment shall be

1-13     submitted to the voters at an election to be held November 4, 1997.

1-14     The ballot shall be printed to permit voting for or against the

1-15     proposition:  "The constitutional amendment establishing that

1-16     rights of criminal defendants under the Texas Constitution are not

1-17     greater than the rights provided by the United States

1-18     Constitution."
