                                  SENATE RESOLUTION

 1-1           BE IT RESOLVED by the Senate of the State of Texas, 75th

 1-2     Legislature, Regular Session, 1997, That Senate Rule 12.03 be

 1-3     suspended in part as provided by Senate Rule 12.08 to enable the

 1-4     conference committee appointed to resolve the differences on House

 1-5     Bill No. 768 to consider and take action on the following matter:

 1-6           Senate Rule 12.03(4) is suspended to permit the committee to

 1-7     add text to Subsection (c), Section 451.002, Labor Code, to read as

 1-8     follows:

 1-9           (c)  The burden of proof in a proceeding under this section

1-10     is on the employee to establish that an action of the employee

1-11     protected under Section 451.001 was a substantial cause of the

1-12     discrimination.

1-13           Explanation:  This change is necessary to clarify the burden

1-14     of proof in certain workers' compensation cases alleging

1-15     discrimination.
