SENATE RESOLUTION
1-1 BE IT RESOLVED by the Senate of the State of Texas, 75th
1-2 Legislature, Regular Session, 1997, That Senate Rule 12.03 be
1-3 suspended in part as provided by Senate Rule 12.08 to enable the
1-4 conference committee appointed to resolve the differences on House
1-5 Bill No. 318 to consider and take action on the following specific
1-6 matter:
1-7 Senate Rule 12.03(4) is suspended to permit the committee to
1-8 add Section 12.1011, Education Code, to read as follows:
1-9 Sec. 12.1011. PUBLIC EDUCATION GRANT CHARTERS. (a) In
1-10 addition to the other charters authorized under this subchapter, in
1-11 accordance with this subchapter the State Board of Education may
1-12 grant:
1-13 (1) not more than 100 charters for open-enrollment
1-14 charter schools that adopt an express policy providing for the
1-15 admission of students eligible for a public education grant under
1-16 Subchapter G, Chapter 29; and
1-17 (2) additional charters for open-enrollment charter
1-18 schools for which at least 75 percent of the prospective student
1-19 population, as specified in the proposed charter, will be students
1-20 who have dropped out of school or are at risk of dropping out of
1-21 school as defined by Section 29.081.
1-22 (b) An open-enrollment charter school granted a charter
1-23 under this section may serve students who are not eligible for a
2-1 public education grant under Subchapter G, Chapter 29, but a school
2-2 granted a charter under Subsection (a)(2) must maintain, as a
2-3 condition of its charter, the required percentage of students.
2-4 Explanation: This change is necessary to permit the
2-5 committee to permit the State Board of Education to authorize
2-6 additional open-enrollment charter schools to serve students who
2-7 are eligible for public education grants, who have dropped out of
2-8 school, or who are at risk of dropping out of school.
