SENATE RESOLUTION
1-1 BE IT RESOLVED by the Senate of the State of Texas, 75th
1-2 Legislature, Regular Session, 1997, That Senate Rule 12.03 be
1-3 suspended in part as provided by Senate Rule 12.08 to enable the
1-4 conference committee appointed to resolve the differences on Senate
1-5 Bill No. 360 to consider and take action on the following matters:
1-6 (1) Senate Rule 12.03(4) is suspended to permit the
1-7 committee to add new SECTIONS 4.03 and 4.04 to the bill to read as
1-8 follows:
1-9 SECTION 4.03. Subsection (c), Section 411.002, Government
1-10 Code, is amended to read as follows:
1-11 (c) The Department of Public Safety of the State of Texas is
1-12 subject to Chapter 325 (Texas Sunset Act). Unless continued in
1-13 existence as provided by that chapter, the department is abolished
1-14 and Subsections (a) and (b) expire September 1, 1999 [2005].
1-15 SECTION 4.04. The Department of Public Safety shall pay the
1-16 costs incurred by the Sunset Advisory Commission in performing the
1-17 review of the department under Section 411.002(c), Government Code,
1-18 as amended by this Act. The Sunset Advisory Commission shall
1-19 determine the amount of the costs, and the department shall pay the
1-20 amount promptly on receipt of a statement from the commission
1-21 showing the costs.
1-22 Explanation: This change is necessary to provide for an
1-23 earlier sunset review of the Department of Public Safety and
2-1 provide for the payment of the cost of that review.
2-2 (2) Senate Rule 12.03(4) is suspended to permit the
2-3 committee to add new SECTIONS 4.08 and 4.09 to the bill and to add
2-4 Subsections (d) and (e) to Section 6.01 of the bill to read as
2-5 follows:
2-6 (a) SECTIONS 4.08 and 4.09 are added to read as follows:
2-7 SECTION 4.08. Section 201.204, Transportation Code, is
2-8 amended to read as follows:
2-9 Sec. 201.204. SUNSET PROVISION. The Texas Department of
2-10 Transportation is subject to Chapter 325, Government Code (Texas
2-11 Sunset Act). Unless continued in existence as provided by that
2-12 chapter, the department is abolished September 1, 1999 [1997].
2-13 SECTION 4.09. Section 361.003, Transportation Code, is
2-14 amended to read as follows:
2-15 Sec. 361.003. SUNSET PROVISION. The Texas Turnpike
2-16 Authority is subject to Chapter 325, Government Code (Texas Sunset
2-17 Act). Unless continued in existence as provided by that chapter,
2-18 the authority is abolished and this chapter expires September 1,
2-19 1999 [1997].
2-20 (b) Subsections (d) and (e) are added to SECTION 6.01 to
2-21 read as follows:
2-22 (d) The section of this Act that amends Section 201.204,
2-23 Transportation Code, takes effect only if the 75th Legislature,
2-24 Regular Session, 1997, does not enact other legislation that
2-25 becomes law and that amends Section 201.204, Government Code, to
3-1 extend the sunset date of the Texas Department of Transportation.
3-2 (e) The section of this Act that amends Section 361.003,
3-3 Transportation Code, takes effect only if the 75th Legislature,
3-4 Regular Session, 1997, does not enact other legislation that
3-5 becomes law and that amends Section 361.003, Government Code, to
3-6 extend the sunset date of the Texas Turnpike Authority.
3-7 Explanation: This change is necessary to provide for the
3-8 continuation of the Texas Department of Transportation and the
3-9 Texas Turnpike Authority if the 75th Legislature, Regular Session,
3-10 1997, does not enact other legislation that becomes law that would
3-11 continue those agencies.
