LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 75th Regular Session May 13, 1997 TO: Honorable Judith Zaffirini, Chair IN RE: House Bill No. 446, As Engrossed Committee on Health & Human Services By: Maxey Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on HB446 ( Relating to the establishment of trusts for certain recipients of medical assistance.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by HB446-As Engrossed No significant fiscal implication to the State is anticipated. The bill would amend Chapter 101 of the Human Resources Code by adding Section 101.031. The bill would require the Department on Aging to allocate available state funds to area agencies on aging for use in contracting with one or more attorneys for the establishment of Miller Trusts. Area agencies on aging currently provide assistance in establishing Miller Trusts with funds allocated by the Department on Aging. A portion of such funds purchase legal advice from attorneys.
