                               75th Regular Session

TO: Honorable John Whitmire, Chair IN RE: House Bill No. 500, As Engrossed
Committee on Criminal Justice By: Finnell
          Senate
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on HB500 ( Relating
to application of the professional prosecutors law to the district
attorney of the 50th Judicial District.) this office has detemined
the following:

Biennial Net Impact to General Revenue Funds by HB500-As Engrossed

Implementing the provisions of the bill would result in a net
negative impact of $(72,709) to General Revenue Related Funds
through the biennium ending August 31, 1999.

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

The bill would apply the Professional Prosecutors
Act to the district attorney for the 50th Judicial District.
The bill would take effect on passage.

Fiscal Analysis

The bill would provide for an increase in salary for the district
attorney for the 50th Judicial district.

Methodolgy

The increase would be $32,315 annually however, since the bill
takes effect immediately on passage we assume that would begin
in June of 1997. That would be three months additional salary
in FY 97 at $2,693 per month or $8,079 in FY 97.
The probable fiscal implications of implementing the provisions
of the bill during each of the first six years following passage
is estimated as follows:

Six Year Impact:

Fiscal Year Probable Change in Number
            Savings/(Cost) of State
            from General Employees from

               2002 0

Similar annual fiscal implications would continue as long as
the provisions of the bill are in effect.

No fiscal implication to units of local government is anticipated.
