LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 75th Regular Session April 18, 1997 TO: Honorable Kenneth Armbrister, Chair IN RE: House Bill No. 833, As Engrossed Committee on State Affairs By: Junell Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on HB833 ( Relating to the exemption of state-owned real property from forced sale.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by HB833-As Engrossed No fiscal implication to the State is anticipated. The bill would explicitly provide an exemption for state-owned real property, including real property held in the name of a state agency or fund, from attachment, execution or forced sale. If a person obtains a judgment lien or abstract of judgment against the State, the bill would not allow that person to have the property "seized" or sold at a sheriff's sale. Since this bill would codify the common law doctrine that already exempts state real property, no fiscal implication to the State is anticipated.
