          Senate
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on HB833 ( Relating
to the exemption of state-owned real property from forced sale.)
this office has detemined the following:

Biennial Net Impact to General Revenue Funds by HB833-As Engrossed

No fiscal implication to the State is anticipated.

The bill would explicitly provide an exemption for state-owned
real property, including real property held in the name of a
state agency or fund, from attachment, execution or forced sale.
If a person obtains a judgment lien or abstract of judgment
against the State, the bill would not allow that person to have
the property "seized" or sold at a sheriff's sale. Since this
bill would codify the common law doctrine that already exempts
state real property, no fiscal implication to the State is anticipated.

No fiscal implication to units of local government is anticipated.
