Bosse, Chair IN RE: House Bill No. 833, Committee Report 1st House, Substituted Committee on Land and Resource Management By: Junell House Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on HB833 ( Relating to exempting real property owned by this state from attachment, execution, or forced sale.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by HB833-Committee Report 1st House, Substituted No fiscal implication to the State is anticipated. This bill would explicitly provide an exemption for state-owned real property, including real property held in the name of a state agency or fund, from attachment, execution or forced sale. If a person obtains a judgment against the State, this bill would not allow that person to have the property "seized" or sold at a sheriff's sale. Since this bill would codify the common law doctrine that already exempts state real property, no fiscal implication to the State is anticipated.
