TO: Honorable Fred M. Bosse, Chair IN RE: House Bill No. 833
Committee on Land and Resource Management By: Junell
          House
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on HB833 ( Relating
to exempting real property owned by this state from attachment,
execution, or forced sale.) this office has detemined the following:

Biennial Net Impact to General Revenue Funds by HB833-As Introduced

No fiscal implication to the State is anticipated.

This bill would explicitly provide an exemption for state-owned
real property, including real property held in the name of a
state agency or fund, from attachment, execution or forced sale.
If a person obtains a judgment against the State, this bill
would not allow that person to have the property "seized" or
sold at a sheriff's sale. Since this bill would codify the
common law doctrine that already exempts state real property,
no fiscal implication to the State is anticipated.

No fiscal implication to units of local government is anticipated.
