TO: Honorable James E. "Pete" Laney IN RE: House Bill No. 1155, As Passed 2nd House
          Speaker of the House Hightower
          House of Representatives
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on HB1155 ( Relating
to the continuation and functions of the Criminal Justice Policy
Council.) this office has detemined the following:

Biennial Net Impact to General Revenue Funds by HB1155-As Passed 2nd House

Implementing the provisions of the bill would result in a net
impact of $0 to General Revenue Related Funds through the biennium
ending August 31, 1999.

The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.

Fiscal Analysis

The bill would amend Chapter 412, Government
Code, as amended, and redesignate Section 413.014 of that chapter
as Sections 413.004 and 413.005. The bill would abolish the
Criminal Justice Policy Council Board and allow for governor
appointed advisory boards. The bill continues the agency for
12 years and sets the date for the next Sunset review as September
1, 2009.

Methodology

The Criminal Justice Policy Council
is subject to the provisions of the Texas Sunset Act, and unless
continued by the 75th Legislature, will be abolished September
1, 1997. Funding for the Criminal Justice Policy Council is
included in the General Appropriations Act, as introduced, and
is contingent upon passage on H.B. 1155 or similar legislation.
The appropriations would be financed from general revenue,
grants, and federal funds and would provide $1,193,956 and 28
employees in fiscal year 1998 and $1,193,956 and 28 employees
in fiscal year 1999.

No fiscal implication to units of local government is anticipated.
