LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 75th Regular Session March 2, 1997 TO: Honorable Patricia Gray, Chair IN RE: House Bill No. 1193 Committee on Civil Practices By: Rhodes House Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on HB1193 ( Relating to free trial transcripts for appeals in which an affidavit of inability to pay costs has been filed.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by HB1193-As Introduced No fiscal implication to the State is anticipated. The bill would save counties the cost of preparing a transcript for appealing a judgment from a court by limiting the circumstances under which a clerk of a court must prepare a transcript to the following: 1) the appeal is non-frivolous and requires both a statement of facts and the clerk's transcript in order to decide the issue, and 2) an affidavit of inability to pay the cost of the appeal has been filed.
