LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 75th Regular Session March 25, 1997 TO: Honorable Allen Place, Chair IN RE: House Bill No. 1747 Committee on Criminal Jurisprudence By: Place House Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on HB1747 ( Relating to procedures to deal with an individual who is in the criminal justice system and who has a mental illness or is a person with mental retardation.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by HB1747-As Introduced No significant fiscal implication to the State is anticipated. Fiscal Analysis This bill would clarify and strengthen provisions in the Code of Criminal Procedure related to defendants in the criminal justice system suspected of being mentally ill or mentally retarded. This bill would also add community supervisions and corrections departments to the list of providers under the continuity of care and service program for offenders with mental impairments with funds appropriated for that purpose. Methodology The Department of Mental Health and Mental Retardation currently provides services to defendants determined as having mental illness or mental retardation. Assuming that the intent of this bill is to improve service coordination rather than expand services, there would be no significant fiscal impact to the Department of Mental Health and Mental Retardation or the Department of Criminal Justice from the implementation of this bill. No significant fiscal implication to units of local government is anticipated.
