TO: Honorable Judith Zaffirini, Chair IN RE: House Bill No. 2389, As Engrossed
Committee on Health & Human Services By: Maxey
          Senate
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on HB2389 ( Relating
to the sale of laboratory services to certain persons by the
Texas Department of Health.) this office has detemined the following:

Biennial Net Impact to General Revenue Funds by HB2389-As Engrossed

In the event that the Board of Health were to adopt fees as
reasonable and necessary to cover the costs of delivering the
laboratory services described in this bill, then there would
be no significant fiscal implication to the State.

Charges collected by the Department of Health would be deposited
to the credit of the Department of Health Public Services Fee
GR-Account 0524 (account). The bill would exempt the account
from Section 403.095(b) of the Government Code, concerning the
use for general governmental purposes of dedicated revenue collections
which exceed the amount appropriated.

No fiscal implication to units of local government is anticipated.
