LEGISLATIVE BUDGET BOARD Austin, Texas FISCAL NOTE 75th Regular Session March 24, 1997 TO: Honorable Eddie Lucio, Jr., Chair IN RE: Senate Bill No. 269 Committee on Intergovernmental Relations By: Barrientos Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on SB269 ( Relating to the waiver or alternate use of municipal impact fees.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by SB269-As Introduced No fiscal implication to the State is anticipated. This bill would apply only to municipalities that collect impact fees. This bill would grant cities the authority to waive impact fees for affordable housing programs funded through the Texas Department of Housing and Community Affairs (TDHCA) and to use impact fees to fund first time homebuyer programs. No significant fiscal implication to units of local government is anticipated. This bill could actually have a positive impact on municipalities which have determined that, under current law, they do not have the authority to waive impact fees. Such municipalities would be able to use waived impact fees as matching funds in grant applications for affodable housing, increasing the likelihood that they would receive such grants.
