In response to your request for a Fiscal Note on SB276 ( Relating 
to the delivery and funding of certain mental health, chemical 
dependency, and mental retardation services through networks 
established by community centers; establishing) this office 
has detemined the following:
         
         Biennial Net Impact to General Revenue Funds by SB276-As Introduced
         
No significant fiscal implication to the State is anticipated.
         
The bill would make no appropriation but could provide the legal 
basis for an appropriation of funds to implement the provisions 
of the bill.

This bill would have no significant fiscal impact 
on the Department of Mental Health and Mental Retardation.  
This bill states that any funds received by the network in excess 
of the actual costs of services shall remain with the network, 
provided that the services rendered are of the amount and quality 
agreed to under contract and that performance requirements and 
conditions of the contract are met.  If performance requirements 
are met, any excess funds maintained by the network would be 
available to expand the types or amounts of services and programs 
offered by the community center or community centers.  Any expanded 
programs or services must further the missions of the community 
centers as set out in the plan of such centers and approved 
by the Department of Mental Health and Mental Retardation.  
The bill does not preclude any funds from being returned to 
the payor if performance requirements are not met.  It appears 
the Department of Mental Health and Mental Retardation would 
continue to have the same rights to recoup funds from a non-performing 
community center or centers.
         
 
          
No significant fiscal implication to units of local government 
is anticipated.
