TO: Honorable John Whitmire, Chair IN RE: Senate Bill No. 324
Committee on Criminal Justice By: Armbrister
          Senate
          Austin, Texas

         FROM: John Keel, Director

In response to your request for a Fiscal Note on SB324 ( Relating
to application of the professional prosecutors law to the district
attorney of the 24th Judicial District.) this office has detemined
the following:

Biennial Net Impact to General Revenue Funds by SB324-As Introduced

Implementing the provisions of the bill would result in a net
positive impact of $72,708 to General Revenue Related Funds
through the biennium ending August 31, 1999.

The bill would remove the district attorney of the 24th Judicial
District from the Professional Prosecutors Act, permitting the
district attorney to have a private practice of law.

The
provisions of the bill are effective when the bill is passed.

Fiscal Analysis

Removing the D.A. from the Professional Prosecutors Act will
save approximately $8,078 in FY 97 and $32,315 annually thereafter.

Methodolgy

There would be a savings to the state due to the higher pay
level of the district attorneys in the Professional Prosecutors
Act.
The probable fiscal implications of implementing the provisions
of the bill during each of the first six years following passage
is estimated as follows:
