"Buster" Brown, Chair IN RE: Senate Bill No. 347, Committee Report 1st House, as amended Committee on Natural Resources By: Harris Senate Austin, Texas FROM: John Keel, Director In response to your request for a Fiscal Note on SB347 ( Relating to enforcement by political subdivisions of the National Flood Insurance Program; providing a civil penalty.) this office has detemined the following: Biennial Net Impact to General Revenue Funds by SB347-Committee Report 1st House, as amended No fiscal implication to the State is anticipated. This bill would provide a civil penalty of no more than $100 per day per incident for persons who violate the provisions of the National Flood Insurance Program as prescribed in Subchapter I, Chaper 16, Water Code. The bill would provide Tarrant County with the authority to enforce the provisions of the subchapter and recover the civil penalty provided. Municipalities already enforce the provisions of Subchapter I, although some levy penalties in excess of the $100 per day per incident maximum that would be set by this bill. However, the threat of enforcement is usually sufficient to deter violations, and municipalities rarely assess penalties. Therefore, no significant impact to municipalities is anticipated. It is expected that Tarrant County would likewise experience virtually universal compliance, if it were granted the enforcement provisions of the bill. Therefore, no significant impact to Tarrant County is anticipated.
