In response to your request for a Fiscal Note on SB434 ( Relating
to the provision of mental health services, including the review
of agency rulemaking by the Health and Human Services Commission
and the creation of an advisory committee on inpatient) this
office has detemined the following:
Biennial Net Impact to General Revenue Funds by SB434-As Introduced
No significant fiscal implication to the state is anticipated.
The bill would make no appropriation but could provide the legal
basis for an appropriation of funds to implement the provisions
of the bill.
The bill would amend Section 531.034 of the
Government Code to direct that the Health and Human Services
Commission require the Department of Health and the Department
of Mental Health and Mental Retardation to coordinate activities
relating to rules and policies that deal with mental health
services in inpatient mental health facilities licensed by TDMHMR
or TDH. The Commission is charged with oversight responsibilities
to determine compliance with the provisions by the two agencies.
The
bill would also amend Chapter 571 of the Health and Safety Code
to add a new section that requires Board of Mental Health and
Mental Retardation to appoint a nine-member advisory committee.
The committee's purpose would be to advise and assist the board
and department in the consideration, promulgation, and adoption
of departmental policies and regulations relating to the provision
of mental health services in inpatient mental health facilities
licensed by TDMHMR or TDH.
No fiscal implication to units of local government is anticipated.
