In response to your request for a Fiscal Note on SB570 ( Relating 
to the regulation of subdivisions in certain economically distressed 
counties; providing civil and criminal penalties.) this office 
has detemined the following:
         
         Biennial Net Impact to General Revenue Funds by SB570-As Introduced
         
No fiscal implication to the State is anticipated.
         

         
 
          
FISCAL ANALYSIS

This bill would reinstate authority to enforce 
the platting requirements of the Model Subdivision Rules to 
those counties which are not located within 50 miles of an international 
border.  This would restore such counties' eligibility for funding 
under the Economically Distressed Areas Program (EDAP), from 
which they are currently precluded.

METHODOLOGY

The nine 
counties affected by this bill include:  Bee Coryell, Frio, 
Marion, Newton, Reeves, Sabine, San Patricio and Terrel.

According 
to the Water Development Board, there is approximately $155 
million remaining in uncommitted EDAP funds for which the nine 
counties would be eligible, in addition to eligible border counties. 
 These funds are expected to be committed by the end of fiscal 
year 1999.  The board estimates that the nine counties affected 
by this bill account for approximately $123 million in eligible 
projects out of approximately $350 million in eligible projects 
throughout the state, or about 35 percent of the remaining eligible 
projects. 

FISCAL IMPACT

Assuming all projects are funded 
in the same proportion throughout the state, it is estimated 
that the nine counties affected by this bill could receive 35 
percent of the $155 million remaining EDAP funds, or approximately 
$54 million, between the enactment of this bill and the end 
of fiscal year 1999.
