In response to your request for a Fiscal Note on SB1479 ( Relating
to civil immunity for volunteers for institutions of higher
education.) this office has detemined the following:
Biennial Net Impact to General Revenue Funds by SB1479-As Introduced
No fiscal implication to the State is anticipated.
Similar annual fiscal implications This bill would provide limited
civil immunity for volunteers at institutions of higher education
who commit a discretionary action within the course and scope
of his/her authority. Granting of immunity would not extend
to negligent actions which caused bodily injury to students
or involved the use of motor-driven vehicles or to gross negligence
or intentional misconduct. Currently, no one is immune from
civil liability for any action that occurs while serving as
a volunteer. This bill would provide some immunity, but does
not provide for representation by the Attorney General or indemnification
for any volunteers who are sued. Any damages and costs arising
from litigation would be paid by individuals and not the State.
Therefore, no fiscal impact to the State is anticipated.
No fiscal implication to units of local government is anticipated.
