Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Tuesday, May 6, 1997 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chair called the meeting to order at 9:05 am. There being
a quorum present, the following business was transacted.
The Chair laid out HB 627 and recognized the Senate sponsor,
Senator Truan, to explain the bill.
At 9:10 am Senator Cain assumed the chair. The Chair moved
that HB 627 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Madla moved that HB 627 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 7 ayes, 0 nays, 0 present not
voting, and 4 absent.
The Chair laid out HB 1632 and recognized the Senate sponsor,
Senator Patterson, to explain the bill. Witnesses registering
on the bill are shown on the attached list. The Chair moved
that HB 1632 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Patterson moved that HB 1632 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 7 ayes, 0 nays, 0 present
not voting, and 4 absent.
Senator Patterson moved that the bill be recommended for
placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
The Chair laid out HB 1170 and recognized Senator Haywood, in
the absence of the Senate sponsor, Senator Shapiro, to explain
the bill. Senator Haywood sent up Committee Amendment 1.
Witnesses registering on the bill are shown on the attached
list. The Chair moved that HB 1170 be left pending to await a
quorum; without objection it was so ordered. Upon arrival of
a quorum, Senator Haywood moved adoption of Committee
Amendment 1; without objection, the amendment was adopted.
Senator Haywood requested unanimous consent to incorporate the
amendment into a committee substitute; without objection, it
was so ordered. Senator Haywood then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Haywood moved that HB 1170 do not pass but
that CSHB 1170 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 5 absent.
Senator Lucio moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 9:15 am Senator Patterson assumed the chair, laid out HB
423 and recognized the Senate sponsor, Senator Cain, to
explain the bill. Witnesses registering on the bill are shown
on the attached list. The Chair moved that HB 423 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Cain moved that HB
423 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 7 ayes, 0 nays, 0 present not voting, and 4 absent.
Senator Cain moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out HB 1971 and recognized the Senate sponsor,
Senator Cain, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Cain sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted.
Senator Cain sent up Committee Amendment 2 and moved adoption;
without objection, the amendment was adopted.
Senator Cain sent up Committee Amendment 3 and moved adoption;
without objection, the amendment was adopted.
Senator Cain requested unanimous consent to incorporate the
amendments into a committee substitute; without objection, it
was so ordered. Senator Cain then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Cain moved that HB 1971 do not pass but that
CSHB 1971 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 0 nays, 0 present not voting,
and 5 absent.
Senator Cain moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 9:30 am Senator Sibley resumed the chair, laid out SB 1798,
which was pending in Committee, and recognized the author,
Senator Wentworth, to explain the bill. Senator Patterson
moved adoption of the committee substitute sent up at an
earlier hearing; without objection, it was so ordered.
Senator Patterson moved that SB 1798 do not pass but that CSSB
1798 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 6 ayes, 0 nays, 0 present not voting, and 5 absent.
Senator Patterson moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
At 9:35 am Senator Cain assumed the chair. The Chair laid out
HB 1976 and recognized the Senate sponsor, Senator Sibley, to
explain the bill. Kevin Brady, representing the Texas
Department of Insurance, testified as a resource witness.
Senator Sibley moved that HB 1976 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 6 ayes, 0 nays, 0 present
not voting, and 5 absent.
Senator Sibley moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out HB 1977 and recognized the Senate sponsor,
Senator Sibley, to explain the bill. Kevin Brady, representing
the Texas Department of Insurance, registered as a resource
witness. Senator Sibley moved that HB 1977 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 7 ayes , 0 nays, 0
present not voting, and 4 absent.
Senator Sibley moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
Senator Sibley resumed the chair at 9:40 am, laid out SB 1931
and explained the bill in the absence of the author, Senator
Bivins. Witnesses testifying and registering on the bill are
shown on the attached list. Senator Sibley moved that SB 1931
be left pending; without objection, it was so ordered.
There being no further business, at 10:00 am Senator Sibley
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
