Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Thursday, May 8, 1997 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chair called the meeting to order at 1:25 pm. There being
a quorum present, the following business was transacted.
The Chair laid out HB 381 and recognized the Senate sponsor,
Senator Madla, to explain the bill. Senator Madla sent up a
committee substitute and explained the difference between the
substitute and the bill as filed. Senator Lucio sent up
Committee Amendment 1 and explained the amendment. Witnesses
testifying and registering on the bill are shown on the
attached list. Senator Sibley closed the public testimony and
moved that HB 381 be left pending; without objection, it was
so ordered.
The Chair laid out SB 1759 and recognized the author, Senator
Haywood, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.

The Chair laid out HB 2105 and recognized the Senate sponsor,
Senator Ellis, to explain the bill. Witnesses registering on
the bill are shown on the attached list. The Chair moved that
HB 2105 be left pending to await a quorum; without objection
it was so ordered. Upon arrival of a quorum, Senator Madla
moved that HB 2105 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 9 ayes, 0 nays, 0 present not voting,
and 2 absent.
Senator Shapleigh moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
At 2:55 pm Senator Cain assumed the chair. The Chair laid out
HB 909 and recognized the Senate sponsor, Senator Sibley, to
explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. Senator Ellis sent up
Committee Amendment 1 and explained the amendment. The Chair
moved that HB 909 and Committee Amendment 1 be left pending to
await a quorum; without objection it was so ordered. Upon
arrival of a quorum, Senator Lucio moved adoption of Committee
Amendment 1; without objection, the amendment was adopted.
Senator Sibley requested unanimous consent to incorporate the
amendment into a committee substitute; without objection, it
was so ordered. Senator Sibley then moved that the new
committee substitute be adopted; without objection, it was so
ordered. Senator Sibley moved that HB 909 do not pass but
that CSHB 909 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 9 ayes, 0 nays, 0 present not voting,
and 2 absent.
At 3:05 pm Senator Sibley resumed the chair. The Chair laid
out HB 976 and recognized the Senate sponsor, Senator
Armbrister, to explain the bill. Senator Cain sent up
Committee Amendment 1 and Senator Armbrister explained the
amendment. Witnesses registering on the bill are shown on the
attached list. The Chair moved that HB 976 be left pending to
await a quorum; without objection it was so ordered. Upon
arrival of a quorum, Senator Cain moved adoption of Committee
Amendment 1; without objection, the amendment was adopted.
Senator Cain then moved that HB 976, as amended, be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 9 ayes, 0 nays,
0 present not voting, and 2 absent.

Senator Armbrister, to explain the bill. The Chair moved that
HB 3354 be left pending to await a quorum; without objection
it was so ordered. Upon arrival of a quorum, Senator
Shapleigh moved that HB 3354 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 10 ayes, 0 nays, 0 present not
voting, and 1 absent.
At 3:15 pm Senator Cain assumed the chair. The Chair laid out
SB 1948 and recognized the author, Senator Sibley, to explain
the bill. Senator Sibley sent up a committee substitute and
explained the difference between the committee substitute and
the bill as filed. Witnesses testifying and registering on
the bill are shown on the attached list. The Chair moved that
SB 1948 be left pending to await a quorum; without objection
it was so ordered. Upon arrival of a quorum, Senator Sibley
moved adoption of the committee substitute; without objection,
it was so ordered. Senator Sibley then moved that SB 1948 do
not pass but that CSSB 1948 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 10 ayes, 0 nays, 0 present not
voting, and 1 absent.
Senator Sibley moved that the bill be recommended for

At 3:20 pm Senator Sibley resumed the chair. The Chair laid
out HB 1853 and recognized the Senate sponsor, Senator
Patterson, to explain the bill. Witnesses testifying and

1853 be left pending; without objection, it was so ordered.
The Chair laid out HB 3383 and recognized the Senate sponsor,
Senator Patterson, to explain the bill. Senator Duncan sent
up Committee Amendment 1. Witnesses testifying and
registering on the bill are shown on the attached list.
The Chair laid out HB 3031 and recognized the Senate sponsor,
Senator Patterson, to explain the bill. Witnesses registering
on the bill are shown on the attached list.
Senator Sibley closed the public testimony and moved that HB
3383 and HB 3031 be left pending; without objection, it was so
ordered.
At 4:20 pm Senator Cain assumed the chair. The Chair laid out
HB 2033 and recognized the Senate sponsor, Senator Sibley, to
explain the bill. Senator Sibley sent up Committee Amendment
1 and explained the amendment. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Sibley moved that HB 2033 and Committee Amendment 1 be
left pending; without objection, it was so ordered.
At 5:00 pm Senator Sibley resumed the chair. The Chair laid
out SB 1932 and recognized the author, Senator Bivins, to
explain the bill. Senator Sibley closed the public testimony
and moved that SB 1932 be left pending; without objection, it
was so ordered.
There being no further business, at 5:10 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
