Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Economic
Development was held on Tuesday, May 13, 1997 in the Lt.
Governor's Committee Room, at Austin, Texas.

The Chair called the meeting to order at 12:25 pm. There
being a quorum present, the following business was transacted.
The Chair advised that HB 3038 and HB 3197 had been tagged
pursuant to Senate Rule 11.20 and would not be heard. The
Chair also advised that HB 1324, HB 2133, HB 3137, HB 3139 and
HB 3196 would not be heard at this meeting.
The Chair laid out HB 1277 and recognized the Senate sponsor,
Senator Lucio, to explain the bill. Senator Lucio sent up
Committee Amendment 1, Committee Amendment 2 and Committee
Amendment 3 and explained the amendments. Witnesses
testifying and registering on the bill are shown on the
attached list. The Chair referred HB 1277 to a subcommittee
for further consideration. The Chair appointed Senator Cain
as Chair of the subcommittee and Senators Ellis, Lucio and
Shapleigh as members of the subcommittee.
The Chair laid out HB 219 and recognized the Senate sponsor,
Senator Patterson, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
The Chair moved that HB 219 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Lucio moved that HB 219 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 0 nays, 0
present not voting, and 3 absent.
Senator Patterson moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.
The Chair laid out HB 839 (the posting rule had been
suspended) and recognized the Senate sponsor, Senator Cain, to
explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. The Chair moved that HB
839 be left pending to await a quorum; without objection it
was so ordered. Upon arrival of a quorum, Senator Harris
moved that HB 839 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 8 ayes, 0 nays, 0 present not voting,
and 3 absent.
Senator Cain moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
At 12:45 pm Senator Cain assumed the chair. The Chair laid
out HB 812 and recognized the Senate sponsor, Senator Sibley.
Senator Sibley recognized the House author, Representative
Janek, to explain the bill. Witnesses registering on the bill
are shown on the attached list. The Chair moved that HB 812
be left pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Sibley sent up
Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Sibley requested unanimous
consent to incorporate the amendment into a committee
substitute; without objection, it was so ordered. Senator
Sibley then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Sibley
moved that HB 812 do not pass but that CSHB 812 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 8 ayes, 0 nays,
0 present not voting, and 3 absent.
At 1:00 pm Senator Sibley resumed the Chair, laid out HB 381,
pending in Committee, and recognized the House author,
Representative Swinford, in the absence of the Senate sponsor,
to explain the bill. Senator Sibley sent up a committee
substitute and Representative Swinford explained the
difference between the committee substitute and the bill as
filed. The Chair moved that HB 381 be left pending to await a
quorum; without objection it was so ordered. Upon arrival of
a quorum, Senator Harris moved adoption of the committee
substitute, without objection, it was so ordered. Senator
Harris then moved that HB 381 do not pass but that CSHB 381 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 8
ayes, 0 nays, 0 present not voting, and 3 absent.
The Chair laid out HB 3197 and recognized the Senate sponsor,
Senator Moncrief, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list.
The Chair moved that HB 3197 be left pending to await a
quorum; without objection it was so ordered. Upon arrival of
a quorum, Senator Sibley moved that HB 3197 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 0 nays, 0
present not voting, and 3 absent.
Senator Ellis moved that the bill be recommended for placement
on the Local & Uncontested Calendar; without objection, it was
so ordered.
The Chair laid out HB 1633 and called Winn Atkins of the
Economic Development Committee staff to explain the bill in
the absence of the Senate sponsor, Senator Shapiro. Carmen
Flores, representing the Texas Secretary of State's office,
testified as a resource on the bill. Senator Sibley moved
that the public hearing be left open and that HB 1633 be left
pending; without objection, it was so ordered.
The Chair laid out HB 3161 and recognized the Senate sponsor,
Senator Duncan, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that HB 3161 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Duncan moved that HB 3161 be reported back to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 0 nays, 0
present not voting, and 3 absent.
At 1:25 pm Senator Cain assumed the chair. The Chair laid out
HB 2033, pending in Committee, and recognized the Senate
sponsor, Senator Sibley. Connie Barron, representing Texas
Medical Association, registered in support of the bill.
Senator Sibley withdrew Committee Amendment 1, sent up at a
previous hearing. Senator Sibley then sent up Committee
Amendment 2 and explained the amendment. The Chair moved that
HB 2033 be left pending to await a quorum; without objection
it was so ordered. Upon arrival of a quorum, Senator Sibley
moved adoption of Committee Amendment 2; without objection,
the amendment was adopted. Senator Sibley requested unanimous
consent to incorporate the amendment into a committee
substitute; without objection, it was so ordered. Senator
Sibley then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Sibley
moved that HB 2033 do not pass but that CSHB 2033 be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 8 ayes, 0 nays,
0 present not voting, and 3 absent.

At 1:35 pm Senator Sibley resumed the chair. The Chair laid
out HB 2438 and recognized the Senate sponsor, Senator Bivins,
to explain the bill. The Chair moved that HB 2438 be left
pending to await a quorum; without objection it was so
ordered. Upon arrival of a quorum, Senator Harris moved that
HB 2438 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 8 ayes, 0 nays, 0 present not voting, and 3 absent.

At 1:40 pm Senator Cain assumed the chair. The Chair laid out
HB 2437 and recognized the Senate sponsor, Senator Sibley, to
explain the bill. Witnesses testifying and registering on the
bill are shown on the attached list. Senator Sibley sent up
Committee Amendment 1 and explained the amendment. The Chair
moved that HB 2437 be left pending to await a quorum; without
objection it was so ordered. Upon arrival of a quorum,
Senator Sibley moved adoption of Committee Amendment 1;
without objection the amendment was adopted. Senator Sibley
requested unanimous consent to incorporate the amendment into
a committee substitute; without objection, it was so ordered.
Senator Sibley then moved that the new committee substitute be
adopted; without objection, it was so ordered. Senator Sibley
moved that HB 2437 do not pass but that CSHB 2437 be reported
back to the Senate with the recommendation that it do pass and

At 1:45 pm, Senator Sibley resumed the chair. The Chair laid
out HB 1173 and recognized the Senate sponsor, Senator Ellis,
to explain the bill. Senator Ellis sent up Committee
Amendment 1 and explained the amendment. Senator Cain sent up
Committee Amendment 2 and explained the amendment. The Chair
then recognized the House author, Representative Coleman, to
speak on the bill. Witnesses testifying and registering on
the bill are shown on the attached list. Senator Sibley moved
that the public hearing be closed and that HB 1173 be left
pending; without objection, it was so ordered.
The Chair laid out HB 1853, pending in Committee, and
recognized Senator Harris, in the absence of the Senate
sponsor, Senator Patterson. Senator Harris moved that HB 1853
be reported favorably to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 8 ayes, 0 nays, 0 present not voting, and 3 absent.
The Chair laid out HB 3031, pending in Committee, and
recognized the Senate sponsor, Senator Patterson. Senator
Patterson moved that HB 3031 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 8 ayes, 0 nays, 0 present
not voting, and 3 absent.
The Chair laid out HB 3383 and recognized the Senate sponsor,
Senator Patterson. Senator Shapleigh moved adoption of
Committee Amendment 1 sent up at a previous hearing; without
objection, the amendment was adopted. Senator Patterson
requested unanimous consent to incorporate the amendment into
a committee substitute; without objection, it was so ordered.
Senator Patterson then moved that the new committee substitute
be adopted; without objection, it was so ordered. Senator
Patterson moved that HB 3383 do not pass but that CSHB 3383 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a vote of 8
ayes, 0 nays, 0 present not voting, and 3 absent.
There being no further business, at 3:30 pm Senator Sibley
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
