Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on
Intergovernmental Relations was held on Wednesday, March 5,
1997 in the Capitol Extension, Room E1.028, at Austin, Texas.

The Chair called the meeting to order at 2:00 pm. There being
a quorum present, the following business was transacted.
The following members arrived after the Committee was called
to order: Senators Cain, Madla, Moncrief, Ogden, and Whitmire.
The Chair announced that at the request of Senator Whitmire,
no action would be taken on SB 699.
The Chair laid out SB 346 and recognized the author, Senator
Barrientos, to explain the bill. Senator Barrientos explained
the measure.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator Moncrief moved that SB 346 be reported favorably to
the full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 11 ayes, 0 nays, 0
present not voting, and 0 absent.
The Chair laid out SB 182 and recognized the author, Senator
Shapiro, to explain the bill. Senator Shapiro explained the
measure.
Senator Shapiro sent up a committee substitute; the Chair
recognized Senator Shapiro to explain the difference between
the committee substitute and the bill filed.
Senator Shapiro moved that SB 182 do not pass but that CSSB
182 be adopted in lieu of the original bill. There being no
objection, it was so moved.

Senator Shapiro moved that CSSB 182 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 11 ayes, 0 nays, 0 present
not voting, and 0 absent.
The Chair laid out the subcommittee report on SB 313 and
recognized the author, Senator Galloway, to explain the
report. Senator Galloway explained the measure.
Senator Galloway moved adoption of the subcommittee report.
The motion carried without objection.
Senator Moncrief moved to re-open public testimony on SB 313.
The motion carried without objection.

The Chair moved to close public testimony. Without objection,
it was so ordered.
Senator Galloway moved that SB 313 be reported favorably to
the full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 7 ayes, 4 nays, 0
present not voting, and 0 absent.
The Chair laid out SB 858 and recognized the author, Senator
Gallegos, Jr., to explain the bill.

Gallegos, Jr., to explain the bill. Senator Gallegos
explained the measures.
At 3:10 pm Senator Galloway assumed the chair.

Senator Gallegos, Jr. moved that SB 858 be reported favorably
to the full Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 8 ayes, 3 nays,
0 present not voting, and 0 absent.
Senator Gallegos, Jr. moved that SB 727 be reported favorably
to the full Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 9 ayes, 2 nays,
0 present not voting, and 0 absent.
At 4:13 pm Senator Galloway assumed the chair.
The Chair laid out SB 436 and recognized the author, Senator
Lucio, Jr., to explain the bill. Senator Lucio, Jr. explained
the measure.
Senator Lucio, Jr. sent up a committee substitute; the Chair
recognized Senator Lucio, Jr. to explain the difference
between the committee substitute and the bill as filed.
Senator Lucio, Jr. moved that SB 436 do not pass but that CSSB
436 be adopted in lieu of the original measure. There being
no objection, it was so moved.

objection, it was so ordered.
Senator Lucio, Jr. moved that SB 436 be left pending; without
objection, it was so ordered.
At 5:05 pm Senator Lucio, Jr. resumed the chair.
The Chair laid out SB 270 and recognized the co-authors,
Senator Haywood and Senator Fraser, to explain the bill.
Senators Haywood and Fraser explained the measure.
At 5:12 pm Senator Galloway assumed the chair.

The Chair moved that SB 270 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Galloway moved SB 270 be reported back to the
senate with the recommendation that it do pass and be printed.
The motion failed to receive an affirmative vote of the
committee with a vote of 5 ayes, 4 nays, 0 present not voting,
and 2 absent.
Senator Lucio, Jr. moved to reconsider the vote on SB 270.
Without objection it was so ordered; Senator Lucio, Jr. moved
that SB 270 be reported favorably to the full Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 6 ayes, 3 nays, 0 present not voting,
and 2 absent.
The Chair laid out SB 651 and recognized the author, Senator
Carona, to explain the bill. Senator Carona explained the
measure.
Senator Carona sent up a committee substitute; the Chair
recognized Senator Carona to explain the difference between
the committee substitute and the bill as filed.

The Chair moved that SB 651 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Carona moved that SB 651 do not pass but that
CSSB 651 be adopted in lieu of the original bill. There being
no objection, it was so moved.
Senator Carona moved CSSB 651 be reported back to the senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 9 ayes, 1 nay, 0 present not
voting, and 1 absent.
The Chair laid out SB 655 and recognized the author, Senator
Lindsay, to explain the bill. Senator Lindsay explained the
measure.

The Chair moved that SB 655 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Lindsay moved SB 655 be reported back to the
senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 10 ayes, 0 nays, 0 present
not voting, and 1 absent.
Senator Lindsay requested unanimous consent to certify the
bill for Local & Uncontested Calendar; without objection, it
was so ordered.
The Chair laid out SB 501 and recognized Senator Carona, in
the absence of the author, to explain the bill. Senator
Carona explained the measure.

Senator Moncrief moved that SB 501 be reported favorably to
the full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 10 ayes, 0 nays, 0
present not voting, and 1 absent.
Senator Carona requested unanimous consent to certify the bill
for Local & Uncontested Calendar; without objection, it was so
ordered.
At 5:50 pm Senator Lucio, Jr. resumed the chair.
No action was taken on SB 307.
There being no further business, at 6:20 pm Senator Moncrief
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
