         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Wednesday, April 23,  
         1997 in the Capitol Extension, Room E1.028, at Austin, Texas.

         The Chair called the meeting to order at 2:35 pm.  The  
         following business was transacted:   
          
         Having stood at recess, the following members arrived after  
         the roll was called:  Senators Galloway, Cain, Carona,  
         Gallegos, Jr., Lindsay, Madla, Moncrief, Ogden, and Whitmire. 
          
         The Chair announced that HB 1638, at the request of its  
         author, would not be heard. 
          
         The Chair laid out SJR 47 and recognized the author, Senator  
         Sibley, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that SJR 47 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Gallegos, Jr. moved SJR 47 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 9 ayes, 2 nays, 0  
         present not voting, and 0 absent.   
  
         The Chair laid out HB 2277 and recognized the Senate sponsor,  
         Senator Haywood, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.   
          
         The Chair moved that HB 2277 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Gallegos, Jr. moved HB 2277 be reported back  
         to the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Carona moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
         The Chair laid out SB 1260 and recognized the author, Senator  
         Barrientos, to explain the bill.

         The Chair moved that SB 1260 be left pending to await a  
         quorum; without objection it was so ordered.  Upon arrival of  
         a quorum, Senator Lindsay moved SB 1260 be reported back to  
         the senate with the recommendation that it do pass and be  
         printed.  The motion carried with a vote of 11 ayes, 0 nays, 0  
         present not voting, and 0 absent.   
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar, without objection, it was  
         so ordered.   
          
         The Chair laid out SB 1363 and recognized the author, Senator  
         Barrientos, to explain the bill.

         The Chair laid out SB 1365 and recognized the author, Senator  
         Barrientos, to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Lucio, Jr. moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Lucio, Jr. moved that SB 1365 do not pass but that  
         CSSB 1365 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 9 ayes, 2 nays, 0 present not voting,  
         and 0 absent.   
          
         The Chair laid out HB 991 and recognized the Senate sponsor,  
         Senator Lindsay, to explain the bill.

         The Chair moved that HB 991 be left pending to await a quorum;  
         without objection it was so ordered.  Upon arrival of a  
         quorum, Senator Lindsay moved HB 991 be reported back to the

         At 4:05 pm Senator Gallegos, Jr. assumed the chair.   
          
         The Chair laid out SB 1203 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.

         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.

         without objection, it was so ordered. 
          
         At 4:07 pm Senator Lindsay assumed the chair.

         CSSB 1203 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion

         and 0 absent.   
          
         Senator Whitmire moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At 4:15 pm Senator Lucio, Jr. resumed the chair.   
          
         The Chair laid out HB 1651 and recognized the Senate sponsor,  
         Senator Wentworth, to explain the bill.   
          
         Witnesses testifying and registering on the bill are shown on

         Senator Gallegos, Jr. moved that HB 1651 be reported favorably  
         to the full Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a vote of 10 ayes, 0  
         nays, 0 present not voting, and 1 absent.   
          
         Senator Lindsay moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out SJR 40 and recognized the author, Senator  
         Wentworth, to explain the bill.   
          
         At 4:20 pm Senator Cain assumed the chair.

         At 4:30 pm Senator Lucio, Jr. resumed the chair.   
          
         The Chair laid out SB 1434 and recognized the author, Senator  
         Wentworth, to explain the bill.

         The Chair recognized Senator Madla for a parliamentary  
         inquiry.  Senator Madla raised a point of order on SJR 40 and  
         SB 1434. 
          
         The Committee stood at ease in order to allow examination of  
         the rules in relation to the inquiry.   
          
         The Committee reconvened and Senator Madla withdrew his point  
         of order, thus waiving his request for a ruling at the present  
         time. 
          
         Senator Lindsay sent up Committee Amendment 1. 
          
         The Chair closed public testimony and referred SB 1434 and SJR  
         40 to the Subcommittee on City/County Consolidation  for  
         further consideration.  The Chair appointed Senator Madla as  
         Chair of the subcommittee and Senators Galloway and Gallegos,  
         Jr. as members of the subcommittee. 
          
         At 5:10 pm Senator Galloway assumed the chair.   
          
         The Chair laid out SB 18 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.   
          
         Senator Gallegos, Jr. sent up a committee substitute; the  
         Chair recognized Senator Gallegos, Jr. to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Gallegos, Jr. moved adoption of the committee  
         substitute, without objection, it was so ordered.

         Senator Gallegos, Jr. moved that SB 18 do not pass but that  
         CSSB 18 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a

         Senator Gallegos, Jr. moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At 5:20 pm Senator Lucio, Jr. resumed the chair.   
          
         The Chair laid out SB 19 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.   
          
         Senator Gallegos, Jr. sent up a committee substitute; the  
         Chair recognized Senator Gallegos, Jr. to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Gallegos, Jr. moved adoption of the committee  
         substitute, without objection, it was so ordered.

         Senator Gallegos, Jr. requested unanimous consent to  
         incorporate amendments into the committee substitute.  Senator  
         Gallegos, Jr. then moved that the new committee substitute be  
         adopted.  Senator Gallegos, Jr. moved that SB 19 do not pass  
         but that CSSB 19 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a vote of 11 ayes, 0 nays, 0 present not voting,  
         and 0 absent.   
          
         Senator Whitmire moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         At 5:25 pm Senator Galloway assumed the chair.   
          
         The Chair laid out SB 1455 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.   
          
         Senator Lucio, Jr. sent up a committee substitute; the Chair  
         recognized Senator Lucio, Jr. to explain the difference  
         between the committee substitute and the bill as filed.   
         Senator Lucio, Jr. moved adoption of the committee substitute,  
         without objection, it was so ordered.

         Senator Lucio, Jr. moved that SB 1455 be left pending; without  
  
         objection, it was so ordered. 
          
         The Chair announced that, at the request of the Senate  
         Sponsor, Senator Armbrister, public testimony would be taken  
         on HB 1638. 
           
         The Chair laid out HB 1638 and recognized Senator Lucio, Jr.,  
         in the absence of the Senate sponsor, to explain the bill.   
          
         Senator Lucio, Jr. moved that HB 1638 be reported favorably to  
         the full Senate with the recommendation that it do pass and be  
         printed.   
          
         Senator Lucio, Jr. asked to withdraw the motion to report and  
         moved that HB 1638 be left pending; without objection, it was  
         so ordered. 
          
          At 5:45 pm Senator Lucio, Jr. resumed the chair.   
          
         The Chair laid out SB 1425 and recognized the author, Senator  
         Nelson, to explain the bill.   
          
         Senator Lindsay sent up a committee substitute; the Chair  
         recognized Senator Nelson to explain the difference between  
         the committee substitute and the bill as filed.  Senator  
         Lindsay moved adoption of the committee substitute, without  
         objection, it was so ordered.

         Senator Shapiro moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar, without  
         objection, it was so ordered.   
          
         The Chair laid out SB 1451 and recognized the author, Senator  
         Nelson, to explain the bill.
