Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Wednesday, March 26, 1997 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:05 am. The
following business was transacted.
Senator Bivins brought the issue of limiting testimony before
the committee. He proposed a 3 minute time limit if there are
more than 10 witnesses registered to testify on a bill. There
being no objection to the adoption of the policy, it was so
ordered.
The Chair laid out SB 1028 and recognized the author, Senator
Sibley, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Sibley moved that SB 1028 be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 11 ayes, 0 nays, 0
present not voting, and 0 absent. Senator Sibley requested
unanimous consent to certify the bill for Local & Uncontested
Calendar; without objection, it was so ordered.
The Chair laid out SB 274 and recognized the author, Senator
Lucio, Jr., to explain the bill. Senator Haywood sent up a
committee substitute; the Chair recognized Senator Lucio, Jr.
to explain the difference between the committee substitute and
the bill as filed. Senator Luna moved adoption of the
committee substitute, without objection, it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list. The Chair moved that SB 274 be left
pending to await the drafting of an amendment; without
objection it was so ordered. Senator Bivins sent up Committee
Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Luna requested unanimous
consent to incorporate amendments into the committee
substitute; without objection it was so ordered. Senator Luna
then moved that the new committee substitute be adopted;
without objection it was so ordered. Senator Luna moved that
SB 274 do not pass but that CSSB 274 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 11 ayes, 0 nays, 0 present
not voting, and 0 absent.
The Chair laid out SB 816 and recognized the author, Senator
Truan, to explain the bill. The Chair laid out SB 1044 and
recognized the author, Senator Truan, to explain the bill.

favorably to the full Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 11

Luna moved that SB 1044 be reported favorably to the full
Senate with the recommendation that it do pass and be printed.

not voting, and 0 absent. Senator Luna requested unanimous

At 9:50 am Senator Luna assumed the Chair.
The Chair laid out SB 1577 and recognized the author, Senator
Bivins, to explain the bill. Senator Bivins sent up a
committee substitute; the Chair recognized Senator Bivins to
explain the difference between the committee substitute and
the bill as filed. Witnesses testifying and registering on

that SB 1577 do not pass but that CSSB 1577 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 8 ayes, 1 nay, 0
present not voting, and 2 absent.
The Chair laid out SB 517 and recognized the author, Senator
Bivins, to explain the bill. Senator Bivins sent up a
committee substitute; the Chair recognized Senator Bivins to
explain the difference between the committee substitute and
the bill as filed. Senator Bivins moved adoption of the
committee substitute, without objection, it was so ordered.

the attached list. The bill was left pending until the
committee reconvened after session.
At 10:53 am Senator Bivins resumed the Chair.
At 10:55 am the committee recessed until 30 minutes after
adjournment of the session.
At 3:25 pm the committee reconvened.
At 3:30 pm Senator Sibley assumed the Chair.
The committee continued to hear testimony on SB 517.
At 4:00 pm Senator Haywood assumed the Chair.
Senator Bivins sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Bivins moved that SB 517 be left pending; without
objection, it was so ordered.
At 4:15 pm Senator Bivins resumed the Chair.
The Chair laid out SB 806 and recognized the author, Senator
Ogden, to explain the bill. Senator Shapleigh sent up a
committee substitute; the Chair recognized Senator Ogden to
explain the difference between the committee substitute and
the bill as filed.
At 4:35 pm Senator Shapleigh assumed the Chair.
Witnesses testifying and registering on the bill are shown on
the attached list. Senator Shapleigh moved that SB 806 be
left pending; without objection, it was so ordered.
The Chair laid out SB 583 and recognized Senator Haywood, in
the absence of the author, to explain the bill. Senator
Haywood sent up a committee substitute; the Chair recognized
Senator Haywood to explain the difference between the
committee substitute and the bill as filed. Senator Haywood
moved adoption of the committee substitute, without objection,
it was so ordered.
At 5:00 pm Senator Bivins resumed the Chair.

1 and moved adoption; without objection, the amendment was
adopted. Senator Luna requested unanimous consent to
incorporate amendments into the committee substitute. Senator
Ratliff then moved that the new committee substitute be
adopted. Senator Ratliff moved that SB 583 do not pass but
that CSSB 583 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 11 ayes, 0 nays, 0 present not voting,
and 0 absent.
At 5:15 pm Senator Luna assumed the Chair.
Because of the fiscal implications of CSSB 1577, the Chair
recognized Senator Bivins for a motion to re-open the bill for
consideration and to reconsider the vote by which CSSB 1577
was reported from committee; there being no objection, the
motion prevailed. The Chair laid out CSSB 1577 and recognized
Senator Bivins to offer an amendment. Senator Bivins sent up
Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Bivins requested unanimous
consent to incorporate amendment into the committee
substitute. Senator Bivins then moved that the new committee
substitute be adopted. Senator Bivins moved that SB 1577 do
not pass but that CSSB 1577 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a vote of 10 ayes, 1 nay, 0 present not
voting, and 0 absent.
The Chair laid out SB 519 and recognized the author, Senator
Bivins, to explain the bill. Witnesses testifying and

Senator Bivins sent up Committee Amendment 1 and moved
adoption. The motion carried with a vote of 5 ayes, 1 nay, 0
present not voting, and 5 absent. Senator Bivins requested
unanimous consent to incorporate amendments into the bill;
without objection, it was so ordered. Senator Bivins moved
that SB 519 do not pass but that CSSB 519 be reported back to
the Senate with the recommendation that it do pass and be
printed. There being objection, the motion carried with a
vote of 9 ayes, 1 nay, 0 present not voting, and 1 absent.
At 5:34 pm Senator Bivins resumed the chair.
There being no further business, at 5:35 pm Senator Bivins
moved that the Committee stand recessed subject to the call of
the Chair. Without objection, it was so ordered.
