Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Education
was held on Saturday, May 17, 1997 in Lt. Governor's Committee
Room, at Austin, Texas.

The Chair called the meeting to order at 12:10 pm. The
following business was transacted.
The Chair laid out HB 2061 and recognized the Senate sponsor,
Senator Patterson, to explain the bill. The Chair moved that
HB 2061 be left pending to await a quorum; without objection
it was so ordered. Upon arrival of a quorum, Senator Haywood
moved HB 2061 be reported back to the senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 10 ayes, 0 nays, 0 present not voting,
and 1 absent. Senator Haywood moved that the bill be
recommended for placement on the Local & Uncontested Calendar,
without objection, it was so ordered.
The Chair laid out HB 1606 and recognized the Senate sponsor,
Senator Harris, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that HB 1606 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Sibley moved HB 1606 be reported back to the
senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 10 ayes, 0 nays, 0 present
not voting, and 1 absent. Senator Haywood moved that the bill
be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.

Senator Lindsay, to explain the bill. Witnesses testifying

objection, the amendment was adopted. Senator Barrientos sent

objection, the amendment was adopted. Senator Barrientos
requested unanimous consent to incorporate amendments into the
bill to create a committee substitute. Senator Barrientos
then moved that the new committee substitute be adopted. The
Chair moved that HB 583 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Barrientos moved that HB 583 do not pass but
that CSHB 583 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion

The Chair laid out HB 2146 and recognized the Senate sponsor,
Senator Ellis, to explain the bill.

the attached list. Senator Shapleigh sent up Committee
Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Shapleigh requested unanimous
consent to incorporate amendments into the bill to create a
committee substitute. Senator Shapleigh then moved that the
new committee substitute be adopted. The Chair moved that HB
2146 be left pending to await a quorum; without objection it
was so ordered. Upon arrival of a quorum, Senator Luna moved
that HB 2146 do not pass but that CSHB 2146 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 9 ayes, 0 nays, 0
present not voting, and 2 absent. Senator Luna moved that the
bill be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.
The Chair laid out HB 2517 and recognized the Senate sponsor,
Senator Shapleigh, to explain the bill. Senator Shapleigh
sent up a committee substitute; the Chair recognized Senator
Shapleigh to explain the difference between the committee
substitute and the bill as filed. Senator Shapleigh moved
adoption of the committee substitute, without objection, it
was so ordered. Witnesses testifying and registering on the
bill are shown on the attached list. Senator Shapleigh moved
that HB 2517 do not pass but that CSHB 2517 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 10 ayes, 0 nays, 0
present not voting, and 1 absent. Senator Sibley moved that
the bill be recommended for placement on the Local &
Uncontested Calendar, without objection, it was so ordered.
At 12:44 pm Senator Shapleigh assumed the chair.
The Chair laid out HB 2491 and recognized Senator Bivins, in
the absence of the Senate sponsor, to explain the bill.
Senator Bivins sent up a committee substitute; the Chair
recognized Senator Bivins to explain the difference between
the committee substitute and the bill as filed. Senator
Bivins moved adoption of the committee substitute, without
objection, it was so ordered. Witnesses testifying and
registering on the bill are shown on the attached list. The
Chair moved that HB 2491 be left pending to await a quorum;
without objection it was so ordered. Upon arrival of a
quorum, Senator Fraser moved that HB 2491 do not pass but that
CSHB 2491 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 9 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator West moved that the bill be recommended
for placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
At 12:51 pm Senator Bivins resumed the chair.
The Chair laid out HB 3249 and recognized the Senate sponsor,
Senator Luna, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list.
Senator Luna sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted. Senator Luna
sent up Committee Amendment 2 and moved adoption; without
objection, the amendment was adopted. Senator Bivins sent up
Committee Amendment 3 and moved adoption; without objection,
the amendment was adopted. Senator Luna requested unanimous
consent to incorporate amendments into the bill to create a
committee substitute. Senator Luna then moved that the new
committee substitute be adopted. Senator Luna moved that HB
3249 do not pass but that CSHB 3249 be reported back to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a vote of 8 ayes, 0 nays, 0 present
not voting, and 3 absent.
At 1:09 pm Senator Luna assumed the chair.
The Chair laid out SCR 95 and recognized the author, Senator
Bivins, to explain the bill. Senator Bivins moved that SCR 95
be reported favorably to the full Senate with the
recommendation that it do pass and be printed. The motion
carried with a vote of 10 ayes, 0 nays, 0 present not voting,
and 1 absent. Senator Bivins moved that the bill be
recommended for placement on the Local & Uncontested Calendar,
without objection, it was so ordered.
The Chair laid out CSHB 318 and recognized the Senate sponsor,
Senator Bivins, to explain the reconsideration of the vote by
which this bill was voted out of committee on 5/14/97. The
Chair moved to bring CSHB 318 back up for consideration before
the committee; there being no objection, it was so ordered.
The Chair then moved to reconsider the vote by which CSHB 318
was voted out of committee on 5/14/97; there being no
objection, it was so ordered. Senator Bivins sent up
Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Senator Bivins requested unanimous
consent to incorporate amendments into the committee
substitute. Senator Bivins then moved that the new committee
substitute be adopted. Senator Bivins moved that HB 318 do
not pass but that CSHB 318 be reported back to the Senate with
the recommendation that it do pass and be printed. The motion
carried with a vote of 9 ayes, 0 nays, 0 present not voting,
and 2 absent. Senator Shapleigh moved that the bill be
recommended for placement on the Local & Uncontested Calendar,
without objection, it was so ordered.
There was no action taken on HB 2801 by Seaman/Truan.
At 1:20 pm Senator Bivins resumed the chair.
There being no further business, at 1:20 pm the Chair moved
that the Committee be adjourned. Without objection, it was so
ordered.
