         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on Finance,  
         Subcommittee on Lottery Revenue Dedication, was held on  
         Tuesday, April 15, 1997 in the Capitol Extension, Room E1.016,  
         at Austin, Texas.

         Senator Bivins, the Subcommittee Chair, called the meeting to  
         order at 1:10 pm.  The following business was transacted.   
          
         The following members arrived after the roll was called:   
         none. 
          
         The Chair laid out SB 76 and recognized the author, Senator  
         Haywood, to explain the bill.  Senator Moncrief sent up a  
         committee substitute; the Chair recognized Senator Haywood to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Moncrief moved adoption of the  
         committee substitute, without objection, it was so ordered. 
          
              Burl Buchanan, representing Texas Municipal League,  
              testified in favor of the bill. 
              Pat Narriss, representing City of Burkburnett, testified  
              in favor of the bill. 
              Jim Ray, representing Texas Association of Regional  
              Councils, testified in favor of the bill. 
              Jewel Woods, representing City of Fort Worth, testified  
              in favor of the bill. 
              Tony Zapata, representing City of Victoria, testified in  
              favor of the bill. 
              James Rinn, representing Texas Lottery Commission,  
              testified on the bill. 
  
              Sue Cox, representing Texas Council on Problem and  
              Compulsive Gambling, testified on the bill. 
              Richard Blankenship, representing Texans Against  
              Gambling, testified in opposition to the bill. 
              Spencer R. Baem, representing Self, registered in favor  
              of the bill but did not testify. 
              Pat Baem, representing Self, registered in favor of the  
              bill but did not testify. 
              Beverly Evans, representing Bryan/College Station; Brazos  
              County, registered in favor of the bill but did not  
              testify. 
              Carol Frierson, representing 7F Land & Cattle Co. Lodge,  
              registered in favor of the bill but did not testify. 
              Jerry E. Fox, representing Bryan/College Station; Brazos  
              County, registered in favor of the bill but did not  
              testify.

         Senator Wentworth moved that CSSB 76 be left pending; without  
         objection, it was so ordered. 
          
         The Chair laid out SB 105 and recognized the author, Senator  
         Nelson, to explain the bill.   
          
         Senator Wentworth sent up Committee Amendment 1 and moved  
         adoption.  The motion carried with a vote of 3 ayes, 2 nays, 0  
         present not voting, and 0 absent.   
          
              Richard Blankenship, representing Texas Against Gambling,  
              testified in opposition to the bill. 
              Sue Cox, representing Texas Council on Problem and  
              Compulsive Gambling, testified on the bill. 
              James Rinn, representing Texas Lottery Commission,  
              testified on the bill. 
          
         Senator Nelson moved that SB 105, as amended, be reported back  
         to the full Committee with the recommendation that it do pass  
         and be printed.  The motion carried with a vote of 4 ayes, 0  
         nays, 0 present not voting, and 1 absent.   
          
         The Chair laid out SB 180 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator Moncrief sent up a  
         committee substitute; the Chair recognized Senator Ellis to  
         explain the difference between the committee substitute and  
         the bill as filed.  Senator Moncrief moved adoption of the  
         committee substitute, without objection, it was so ordered. 
  
              Richard Blankenship, representing Texans Against  
              Gambling, testified in opposition to the bill. 
              Sue Cox, representing Texas Council on Problem and  
              Compulsive Gambling, testified on the bill. 
              James Rinn, representing Texas Lottery Commission,  
              testified on the bill. 
              Linda Rucker, representing Self, testified in favor of  
              the bill. 
              Carol McDonald, representing Independent Colleges &  
              Universities of Texas, Inc., registered in favor of the  
              bill but did not testify. 
              Sharon W. Cobb, representing Texas Higher Education  
              Coordinating Board, registered in favor of the bill but  
              did not testify. 
          
         Senator Wentworth moved that CSSB 180 be left pending; without  
         objection, it was so ordered. 
          
         There was no action taken on SB 1093 and SB 1489. 
          
         There being no further business, at 2:30 pm Senator Bivins  
         moved that the Committee be adjourned. Without objection, it  
         was so ordered.
