         Pursuant to a notice posted in accordance with Senate Rule  
         11.11, a public hearing of the Senate Committee on State  
         Affairs was held on Thursday, May 15, 1997 in the Senate  
         Chamber at Austin, Texas.

         The Chair called the meeting to order at 1:50 pm.  There being  
         a quorum present, the following business was transacted.   
          
         The following members arrived after the roll was called:   
         none. 
          
         The Chair laid out HB 92 and recognized the Senate sponsor,  
         Senator Whitmire, to explain the bill.   
         Senator Whitmire sent up CSHB 92. 
          
         Senator Armbrister sent up Committee Amendment 1 and moved  
         adoption.  The motion carried with a vote of 10 ayes, 1 nay, 0  
         present not voting, and 2 absent.   
          
         Senator Carona sent up Committee Amendment 2 and then pulled  
         it down. 
          
         Senator Carona sent up Committee Amendment 3 and moved  
         adoption.  Senator Nelson objected to Committee Amendment 3.   
         The motion to adopt Amendment 3 carried with a vote of 10  
  
         ayes, 1 nay, 0 present not voting, and 2 absent.   
          
         Senator Cain sent up Committee Amendment 4 and moved adoption;  
         without objection, the motion prevailed. 
          
         Senator Cain sent up Committee Amendment 5 and moved adoption;  
         without objection, the motion prevailed. 
          
         Senator Nixon sent up Committee Amendment 6.  Senator Ellis  
         made a motion to table  Committee Amendment 6.  The motion to  
         table Committee Amendment 6 carried with the vote of 8 ayes, 4  
         nays, 0 present not voting, and 1 absent. 
          
         Senator Nixon sent up Committee Amendments 7 and 8 and then  
         pulled the amendments down. 
          
         Senator Armbrister sent up Committee Amendment 9 and moved  
         adoption.  The motion carried with a vote of 8 ayes, 4 nays, 0  
         present not voting, and 1 absent.   
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  Public testimony was closed. 
          
         Senator Whitmire requested unanimous consent to incorporate  
         amendments into the committee substitute.  Senator Whitmire  
         then moved that the new committee substitute be adopted.   
         Senator Whitmire moved that HB 92 do not pass but that CSHB 92  
         be reported back to the Senate with the recommendation that it  
         do pass and be printed.  The motion carried with a vote of 7  
         ayes, 5 nays, 0 present not voting, and 1 absent.   
          
         At 4:40 pm Senator Gallegos, Jr. assumed the chair.   
          
         The Chair laid out HB 1176 and recognized the Senate sponsor,  
         Senator Brown, to explain the bill.

         adoption.  The motion failed by a vote of 3 ayes, 6 nays, 0  
         present not voting, and 4 absent.   
          
         Senator Armbrister requested unanimous consent to incorporate  
         amendments into the committee substitute.  Senator Armbrister  
         then moved that the new committee substitute be adopted.
