Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Criminal
Justice was held on Tuesday, April 1, 1997 in the Capitol
Extension, Room E1.012, at Austin, Texas.

The Chair called the meeting to order at 9:10 am. The
following business was transacted.
The following members arrived after the roll was called:

SB 66 by Moncrief
The Chair laid out SB 66 and recognized the author, Senator
Moncrief, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator West moved that SB 66 be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 6 ayes, 0 nays, 0
present not voting, and 0 absent.
Senator West moved that the bill be recommended for placement
on the Local & Uncontested Calendar, without objection, it was
so ordered.
The Chair requested unanimous consent to show Senator Duncan
voting aye on SB 66 pursuant to Senator Duncan's oral and
written request. This was granted without objection.
The final vote on SB 66 was 7 ayes, 0 nays, 0 present not
voting, and 0 absent.
SB 113 by Moncrief
The Chair laid out SB 113 and recognized the author, Senator
Moncrief, to explain the bill.
Senator West sent up a committee substitute; the Chair
recognized Senator Moncrief to explain the difference between
the committee substitute and the bill as filed. Senator West
moved adoption of the committee substitute, without objection,
it was so ordered.
Witnesses testifying and registering on the bill are shown on
the attached list.
Senator West moved that SB 113 do not pass but that CSSB 113
be reported back to the Senate with the recommendation that it
do pass and be printed. The motion carried with a vote of 6
ayes, 0 nays, 0 present not voting, and 0 absent.
Senator West moved that the bill be recommended for placement
on the Local & Uncontested Calendar, without objection, it was
so ordered.

voting aye on CSSB 113 pursuant to Senator Duncan's oral and

The Chair laid out SB 1001 and recognized the author, Senator
West, to explain the bill.

Senator Shapiro moved that SB 1001 be reported favorably to
the full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 6 ayes, 0 nays, 0
present not voting, and 0 absent.

voting aye on SB 1001 pursuant to Senator Duncan's oral and
written request. This was granted without objection.

SB 625 by Whitmire
The Chair laid out SB 625 and recognized the author, Senator
Whitmire, to explain the bill.
Senator Whitmire sent up a committee substitute; the Chair
recognized Senator Whitmire to explain the difference between
the committee substitute and the bill as filed. Senator
Whitmire moved adoption of the committee substitute, without
objection, it was so ordered.

At 9:54 am Senator Whitmire resumed the chair.
The Chair requested unanimous consent to show Senator Duncan
voting aye on CSSB 625, pursuant to Senator Duncan's oral and
written request. This was granted without objection.

SB 48 by Shapiro
The Chair laid out SB 48 and recognized the author, Senator
Shapiro, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.
Senator West moved that SB 48 be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 6 ayes, 0 nays, 0
present not voting, and 0 absent.
Senator West moved that the bill be recommended for placement
on the Local & Uncontested Calendar, without objection, it was
so ordered.
The Chair requested unanimous consent to show Senator Duncan
voting aye on SB 48, pursuant to Senator Duncan's oral and
written request. This was granted without objection.

SB 80 by Ellis
The Chair laid out SB 80 and recognized the author, Senator
Ellis, to explain the bill.
Senator West sent up Committee Amendment 1 and moved adoption;
without objection, the amendment was adopted.
Witnesses testifying and registering on the bill are shown on
the attached list.
At 10:41 am Senator Whitmire announced that the Committee
stand recessed until 1:30 pm.
The Committee reconvened at 1:35 pm. The Committee heard the
last of the testimony on SB 80.
Pursuant to the request of the author of the bill, SB 80 was
left pending.
There being no further business, at 2:44 pm Senator Whitmire
announced that the Committee stand recessed subject to the
call of the Chair.
