Pursuant to a notice posted in accordance with Senate Rule
11.11, a public hearing of the Senate Committee on Criminal
Justice was held on Thursday, May 15, 1997 in the Capitol
Extension, Room E1.012, at Austin, Texas.

At 1:35 pm Senator Patterson assumed the chair.
The Chair called the meeting to order at 1:35 pm. There being
a quorum present, the following business was transacted.
The following members arrived after the roll was called:

HB 500 by Finnell/Haywood
The Chair laid out HB 500 and recognized the Senate sponsor,
Senator Haywood, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.
HB 844 by McReynolds/Nixon
The Chair laid out HB 844 and recognized Chris Traylor, in the
absence of the Senate sponsor, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list.
HB 462 by Zbranek/Nixon
The Chair laid out HB 462 and recognized Chris Traylor, in the
absence of the Senate sponsor, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.
HB 3588 by Lewis/Harris
The Chair laid out HB 3588 and recognized Senator Patterson,
in the absence of the Senate sponsor, to explain the bill.

The Chair laid out HB 1229 and recognized Senator Patterson,
in the absence of the Senate sponsor, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.

The Chair laid out HB 907 and recognized Senator Patterson, in
the absence of the Senate sponsor, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.
HB 3572 by Cook/Armbrister
The Chair laid out HB 3572 and recognized Senator Patterson,
in the absence of the Senate sponsor, to explain the bill.
The Chair called for public testimony, there being none,
public testimony was closed.
The Chair recessed until 4:30 pm.
At 4:45 pm Senator Whitmire resumed the chair.
The Chair reconvened the hearing at 4:45 pm.
Senator Shapleigh moved that HB 462, HB 500, HB 844, HB 907,
HB 1229, HB 3572, and HB 3588 be reported favorably to the
full Senate with the recommendation that they do pass and be
printed. The motion carried with a vote of 5 ayes, 0 nays, 0
present not voting, and 2 absent.
Senator Shapleigh moved that the bills be recommended for
placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
Senator Patterson moved to take up the following pending bills
for a vote:
HB 818 (Substituted)
HB 1233
HB 2825
HB 2830
HB 3062 (Amended)
Senator Patterson moved that CSHB 818, HB 1233, HB 2825, HB
2830, and HB 3062 (as amended) be reported favorably to the
full Senate with the recommendation that it do pass and be
printed. The motion carried with a vote of 5 ayes, 0 nays, 0
present not voting, and 2 absent.
Senator Patterson moved that HB 1233, HB 2825, HB 2830, and HB
3062 be recommended for placement on the Local & Uncontested
Calendar, without objection, it was so ordered.
HB 2561 by Gallego/Moncrief
Senator Patterson moved that the committee reconsider HB 2561
taken up at the previous meeting to recommend that HB 2561 do
pass and be printed; without objection it was so ordered.
Senator Patterson sent up a committee substitute for HB 2561.
Senator Patterson moved adoption of the committee substitute,
without objection, it was so ordered.
Senator Patterson moved that HB 2561 do not pass but that CSHB
2561 be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.
Senator Patterson moved that the bill be recommended for
placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
At 5:20 pm Senator Patterson assumed the chair.
HB 438 by Alvarado/Whitmire
The Chair recognized Senator Whitmire to take up HB 438, which
was previously left pending.
Senator Whitmire sent up Committee Amendment 1 and moved
adoption; without objection, the amendment was adopted.
Senator Whitmire moved that HB 438, as amended, be reported
back to the Senate with the recommendation that it do pass and
be printed. The motion carried with a vote of 5 ayes, 0 nays,
0 present not voting, and 2 absent.
Senator Whitmire moved that the bill be recommended for
placement on the Local & Uncontested Calendar, without
objection, it was so ordered.
No action was taken on the following bills:

There being no further business, at 5:25 pm Senator Whitmire
announced that the Committee stand recessed subject to the
call of the Chair. Without objection, it was so ordered.
