Amend CSHB 487 by striking page 1, line 23 through page 2,
line 7, and substituting the following:
      (c)  It is an affirmative defense to prosecution under
Subsection (b) that:
            (1)  the person consuming the alcoholic beverage is a
passenger in:
                  (A)  the living quarters of a house coach or
house trailer;
                  (B)  a motor vehicle designed, maintained, or
used primarily for the transportation of persons; or
                  (C)  the vehicle being driven by a person who
requested and was administered a breath test that showed an alcohol
concentration of 0.02 percent; or
            (2)  the receptacle containing the alcoholic beverage
is located in:
                  (A)  a locked storage compartment of the vehicle,
including a locked glove compartment; or
                  (B)  a vehicle that is not equipped with a trunk,
and behind the last upright seat of the vehicle or another area of
the vehicle not normally occupied by the driver or a passenger.
